A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
AN AMENDMENT TO A CONDITIONAL USE PERMIT
ALLOWING AN ADDITION TO AN ATHLETIC CLUB
WITHOUT PROVIDING 12 ADDITIONAL PARKING
SPACES LOCATED AT THE NORTHEAST CORNER OF
ALESSANDRO DRIVE AND SAN CARLOS AVE.
CASE NO. CUP 03-81 (AMENDMENT NO. 1)
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 1st day of February, 1983, hold a duly noticed pubic hearing continued from the 18th
day of January, 1983, to consider the request of JACK O. WISE (WISE PALM DESERT
ATHLETIC CLUB) for approval of a conditional use permit allowing an addition to an
athletic club in the R-3 (4) zone located at the northeast corner of Alessandro Drive and
San Carlos Avenue, more particularly described as:
APN 627-153-011 and 012
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project has been previously assessed in connection with the original consideration of
CUP 03-81 and no further documentation is deemed necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said Commission did find the
following reason to exist to justify the granting of said Conditional Use Permit
Amendment:
1. The findings which were substantiated for the conditional use permit in May,
1981, still apply and can be utilized for this amendment.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in this case.
2. That approval of Conditional Use Permit 03-81 (Amendment #1) is hereby
granted for reasons subject to the attached conditions and applicable
conditions for Planning Commission Resolution No. 705.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 1st day of February, 1983, by the following vote, to
wit:

Conditions of Approval
CUP 03-81 (Amendment #1)
1. Minimum ten foot setback shall be provided for addition adjacent to Alessandro
Drive or adjustment for modification of setback shall be approved prior to issuance
of building permit for addition.
2. Consolidation of the two parcels which make up property (through parcel map or
other legal means) shall be substantially begun prior to issuance of building permit
and consummated by the time the addition is completed.
3. (Amending Condition #21 of Resolution No. 705) Vacant area of site to north shall
be used for additional parking for athletic club. If after 36 months (18 months
originally plus 18 months for this amendment) of operation of the club the City of
Palm Desert determines such parking is necessary to insure the public health,
safety, or general welfare of persons or properties in the vicinity of the site; no
building permit, parcel map, splitting developed land from vacant land, etc., shall
be granted until the above 36 month time has passed and the city has determined
no additional parking is necessary; this restriction may be deleted by the City of
Palm Desert any time.
4. Construction of said addition shall commence within one year from date of this
approval, unless extended by the planning commission; otherwise said approval shall
become null, void and of no effect whatsoever.
5. Five feet of right-of-way shall be dedicated to the city to the satisfaction of the
director of public works, prior to issuance of building permit for the addition.
6. All employees shall park in the parking lot that is located on the east side of the
club.
7. Any future expansion of facilities shall be designed so that off-street parking is
convenient to building entrances and discourages on -street parking.
