A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL APPROVAL
OF A CHANGE OF ZONE FROM PR-4, S.P. TO PR-7, S.P.
AND A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT FOR PROPERTY LOCATED AT THE
NORTHWEST CORNER OF SAN PASCUAL AVENUE AND
FRED WARING DRIVE.
CASE NO. C/Z 01-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 5th day of April, 1983, hold a duly noticed public hearing to consider the request of
SAN PABLO PROPERTIES LTD. for approval of a change of zone from PR-4, S.P. to PR-7
S.P. on 70.28 gross acres for property located at the northwest corner of San Pascual
Avenue and Fred Waring Drive, more particularly described as:
APN 622-160-008, 012 and 013
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, as said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
Did find the following facts to justify their actions, as described below:
1. The proposed change of zone from PR-4, S.P. (Planned Residential,
maximum 4 d.u./gross acre, Scenic Preservation Overlay) to PR-7, S.P.
(Planned Residential, maximum 7 d.u./gross acre, Scenic Preservation
Overlay) is compatible with the general plan land use designation of medium
density residential, 5-7 d.u./acre.
2. The type (condominium and 2-unit structures) of project proposed is
compatible with adjacent residential uses to the east and south due to
residential nature of project. The land uses to the west are non-residential
(future YMCA, COD, future park, and city hall) and more intense than the
proposed land use allowed by the PR-7, S.P. zoning; thus the proposed zoning
provides a buffer for the land uses east of the subject site.
3. The proposed zoning of subject site is PR-7, S.P. with a project density of
6.4 d.u./gross acre is compatible and similar to the overall surrounding
residential densities.
4. The undeveloped nature of the site tends to provide an eyesore in the
vicinity and the unimproved adjacent streets impede proper and safe traffic
circulation; the rezoning to PR-7, S.P. will allow a project which will
improve the aesthetics in the neighborhood, improve traffic circulation and
safety, and not depreciate property values or detrimentally affect the
health, safety or welfare of persons in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in these cases.
2. That the Planning Commission does hereby recommend to the City Council
approval of a change of zone from PR-4, S.P. to PR-7, S.P. as shown on
attached Exhibit "A".
3. That a Negative Declaration of Environmental Impact is hereby approved.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
