A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF 450 RESIDENTIAL UNITS AND A
NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT AT THE NORTHWEST CORNER OF SAN
PASCUAL AVENUE AND FRED WARING DRIVE.
CASE NO. PP 01-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 5th day of April, 1983, hold a duly noticed public hearing to consider the request of
SAN PABLO PROPERTIES, LTD. for approval of a Negative Declaration of Environmental
Impact and a plan of design to allow construction of 450 residential units in the PR-4, S.P.
zone (change of zone to PR-7, S.P. pending) on 70.28 gross acres at the northwest corner
of San Pascual Avenue and Fred Waring Drive, more particularly described as:
APNs 622-160-012, 013 & 008
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 01-83 is hereby granted for reasons subject to
the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of April, 1983, by the following vote, to wit:

CONDITIONS OF APPROVAL
Case No. PP 01-83
Department of Environmental Services:
1. The development of the property shall conform substantially with Exhibits (Case
No. PP 01-83) on file with the department of environmental services, as modified
by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the procedural
requirements of the city which include, but are not limited to, design review,
subdivision process, and building permit procedures.
3. Construction of the total development may be done in phases; however, each
individual phase shall meet or exceed all Municipal Code requirements to the
degree that the city could consider each phase as a single project.
4. Construction of a portion of said project shall commence within two years from the
date of final approval unless a time extension is granted, otherwise said approval
shall become null, void and of no effect whatsoever.
5. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all Municipal
Ordinances and state and federal statutes now in force, or which hereafter may be
in force.
6. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
7. Subdivision to be provided with minimum six foot high solid masonry wall around
project (except for approved openings) with the exception of east property line and
adjacent to city hall site, as approved by design review board; adjacent to park
site, applicants have provided 6 foot high vegetation -covered chain link fence.
8. Landscaped area between common area Lot X and Lot "H-H" (as shown on TT
19074) shall be modified to provide permanent or emergency access between
private streets which dead-end into lots.
9. Height of fencing for two tennis courts adjacent to San Pascual Channel shall be
subject to Design Review Board approval.
10. All tennis court lighting not to exceed 20 feet in height and shall be down -shining
black box type; lighting of two courts adjacent to San Pascual Channel to be
determined during design review process; all court lighting provided with shields to
restrict visibility of light source to east.
11. Units adjacent to Magnesia Falls Drive shall be provided with a rear setback of a
minimum 20 feet from street property line, except unit at northeast corner of site.
12. Approval is subject to amendment of code sections, pertaining to unit sizes and
parking; if code is not amended to accommodate project in entirety or in part,
applicant shall submit modified plan that complies with all applicable code
provisions for planning commission approval.

13. Approval of project is subject to property being rezoned to PR-7, S.P. or other
appropriate zone.
14. That exceptions or modifications to the PR zone development standards as noted in
staff report are approved.
15. All single family attached units shall be provided with a minimum 20 foot deep
driveway.
16. Applicant shall coordinate provisions for mail service with Palm Desert Branch of
U.S. Postal Service.
17. Applicant shall provide adequate signing to indicate parking restricted to one side
for local 32 foot wide streets in single family attached area.
18. Sidewalk on Fred Waring Drive to tie-in with sidewalk on city hall site.
Department of Public Works:
19. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to recordation of the final tract map for property or issuance of building
permits, whichever occurs first.
20. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the director of public works.
21. Full public improvements, including traffic safety lighting as required by ordinance
and the director of public works, shall be installed in accordance with city
standards.
22. Improvement plans for water and sewer systems shall be approved by the
respective service districts.
23. Complete improvement plans and specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as -built" plans prior to
acceptance of the subdivision improvements by the city.
24. All private streets shall be inspected by the engineering department and a standard
inspection fee shall be paid.
25. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
26. Landscaping maintenance of parkways on Fred Waring Drive, Magnesia Falls and
San Pablo Avenue shall be provided by the homeowner's association.
27. Existing utilities on Fred Waring Drive and along west property line shall be
undergrounded.
28. Traffic safety striping on Fred Waring Drive, Magnesia Falls and San Pablo Avenue
shall be provided to the specifications of the director of public works. A traffic
control plan must be submitted to and approved by the director of public works
before placing pavement markings.
29. This property is in the AO Depth 1' zone as shown on Flood Insurance Rate Map. A
flood hazard report as required by Ordinance No. 221 (Flood Damage Prevention
Ordinance) shall be submitted to the public works department. The report must be
approved by the Flood Review Committee prior to recordation of the final map.
30. Dedication of right-of-way to 55 feet from centerline on Magnesia Falls,
dedication of right-of-way to 63 feet from centerline on San Pablo Avenue and
dedication of right-of-way to 63 feet from construction centerline on Fred Waring
Drive.

31. Installation of curb and gutter, medians, median landscaping, sidewalk and asphalt
paving on Fred Waring Drive, San Pablo Avenue and Magnesia Falls to the
specifications of the city engineer.
32. Medians may be required to be 18 feet wide by the city engineer instead of 12 feet
wide as shown on tentative tract map for property. Also, barrel widths will be 34
feet wide instead of 32 feet wide as shown on tentative map.
33. The developer is responsible for the bridge construction on Magnesia Falls crossing
San Pascual Channel, and its cost shall be fully applied as a credit towards required
drainage fees.
34. Access shall be waived on Magnesia Falls, San Pablo Avenue and Fred Waring Drive
except at approved intersections.
35. The private street intersecting with Fred Waring Drive, shall be designed to
satisfaction of director of public works.
36. Irrigation facilities shall be removed or relocated as required.
37. The city is contemplating improving Fred Waring Drive in the 1983-84 fiscal year.
If the city awards a contract for these improvements before the developer makes
their required improvements, the developer shall reimburse the city for their share
of the improvements based on the city's unit prices contract.
Fire Marshal:
38. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
39. Install Riverside County super fire hydrants so that no point of any building is more
than 250 feet from a fire hydrant measured along approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any buildings.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome -
yellow and the tops and nozzle caps shall be painted green.
c. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
40. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
41. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case No. C/Z 01-83 and PP 01-83 is in accordance with the
requirements prescribed by the fire marshal."
42. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
43. Emergency alternate access is required.
44. Additional fire protection requirements may be necessary when specific plans for
recreation buildings are submitted.
45. Emergency vehicle control access through gates shall be approved prior to
installation of access gates.
