HomeMy WebLinkAboutRes No 853PLANNING COMMISSION RESOLUTION NO. 853 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW THE CONSTRUCTION OF A 4.2 ACRE DISTRICT BASE CENTER FOR SOUTHERN CALIFORNIA GAS COMPANY AT 75-095 MAYFAIR DRIVE AND APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREFORE. CASE NO. PP 02-83 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of April, 1983, hold a duly noticed public hearing to consider the request of SOUTHERN CALIFORNIA GAS COMPANY for approval of a precise plan of design to allow construction of a district base center on a 4.2 acre parcel in the S.I. zone at 75-094 Mayfair Drive, more particularly described as: Parcel 3, Parcel Map 18142 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant adverse impact on the environment and that a Negative Declaration of Environmental Impact can be approved therefore. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 02-83 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of April, 1983, by the following vote, to wit: AYES: CRITES, KRYDER, RICHARDS, WOOD NOES: NONE ABSENT: DOWNS ABSTAIN: NONE ATTEST: RAMON A. DIAZ, Secre ary /lr RALPH B. WOOD, Chairman -1- PLANNING COMMISSION RESOLUTION NO. 853 CONDITIONS OF APPROVAL Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, unless modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances including but not limited to zoning, building and health codes, as well as state and federal statutes now in force, or which may be in force at the time of development. 3. Construction of this project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect. 4. Prior to the issuance of a building permit for construction the applicant shall obtain any necessary permits and/or clearances from any necessary public agencies including but not limited to: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearances shall be presented to the department of building and safety at the time of issuance of a building permit for the project set forth herein. 5. Trash enclosures location and access shall be approved by Palm Desert Disposal Company prior to the issuance of building permits. 6. Chain -link fencing shall not be used for open fencing. 7. Wall and landscape treatment shall be so designed as to diffuse the impact of the walls and be approved by the city's architectural commission. -2-
