A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN AND VARIANCE FROM
CITY PARKING REQUIREMENTS TO PERMIT THE
CONSTRUCTION OF APPROXIMATELY 17,000 SQUARE
FEET OF COMMERCIAL AREA AT THE NORTHWEST
CORNER OF EL PASEO AND LARKSPUR LANE AND A
NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT THEREFORE.
CASE NOS. PP 05-83 AND VAR 01-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 19th day of April, 1983, hold a duly noticed public hearing and continued hearing on
May 3, 1983, to consider the request of E.G.S. METRO AND C.G. DUNHAM CO. for
approval of a precise plan of design and parking variance to construct a commercial
facility consisting of three 5640 square foot buildings with pedestrian areas. Said facility
to be located generally on the northwest corner of Larkspur Lane and El Paseo, more
particularly described as:
APN 627-111-004, 005 and 006
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design
and variance:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. That there are exceptional or extraordinary circumstances or conditions
which apply to the property that do not apply generally to other properties
in the same zone which warrants the granting of a variance.
4. That the strict or literal interpretation and enforcement of the parking
regulations deprive the applicant of privileges enjoyed by the owners of
other property in the same vicinity and zone.
5. The granting of the requested precise plan and variance will not be
detrimental to adjoining properties and to the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 05-83 and Variance 01-83 are hereby granted
for reasons subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 3rd day of May, 1983, by the following vote, to wit:

CONDITIONS OF APPROVAL
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, unless modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein in addition to all municipal ordinances
including but not limited to building and health codes, as well as state and federal
statutes now in force, or which may be in force at the time of development.
3. The development of the property described herein shall conform to all city zoning
requirements except those modified by Variance 01-83.
4. Prior to the issuance of a building permit for construction the applicant shall
obtain any necessary permits and/or clearances from any necessary public agencies
including but not limited to:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permits or clearances shall be presented to the department of
building and safety at the time of issuance of a building permit for the project set
forth herein.
5. Trash enclosures location and access shall be approved by Palm Desert Disposal
Company prior to issuance of building permits.
6. The applicant shall provide five additional parking spaces on the west side of the
third building by reducing the total building area of the project.
Department of Fire Marshal:
7. Installation of a water system capable of delivering 3000 gallons per minute fire
flow for a three hour duration in addition to domestic or other supply. The
compulation shall be based upon a minimum 20 psi residual operating pressure in
the supply main from which flow is measured at the time of measurement.
8. Install Riverside County super fire hydrants so that no point of any structure is
more than 200 feet from a hydrant as measured along approved vehicular travel
ways.
a. Hydrants shall not be located closer than 25 feet from any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome -
yellow, and the tops and nozzle caps shall be painted green.
c. Curbs (if installed) shall be painted red, 15 feet in either direction of a
hydrant.
9. Prior to issuance of a building permit the developer shall furnish an original and
three copies of a water system plan to the fire marshal for review and approval.
Said plan shall be signed by a registered civil engineer, approved by the appropriate
water company and contain the following certification: "I certify that the design of
the water system for Case PP 05-83 is in accordance with the requirements
prescribed by the fire marshal."
10. Prior to delivery of combustible materials to the site, the required water system
shall be installed, operating and delivering the required flows.
11. Conditions 6, 7, 8, 9, shall be complied with prior to construction of any building.
12. An approved 20 foot wide fire lane is required along the north side of the proposed
buildings.
13. Additional fire protection requirements may be necessary when specific building
plans are submitted for approvals.
