A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT AND A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF A CHURCH ON THE WEST SIDE OF
MONTEREY AVENUE APPROXIMATELY 350 FEET
NORTH OF PARKVIEW DRIVE.
CASE NO. PP 06-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 17th day of May, 1983, hold a duly noticed public hearing to consider the request of
the TEMPLE SINAI OF THE DESERT for approval of a Negative Declaration of
Environmental Impact and a precise plan of design to allow construction of a church on
2.2 acres in the PR-7 zone on the west side of Monterey Avenue, approximately 350 feet
north of Parkview Drive, more particularly described as APN 618-240-010.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse environmental impact on the environment and a
Negative Declaration of Environmental Impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 06-83 is hereby granted for reasons subject to
the attached conditions.
3. That a Negative Declaration of Environmental Impact is hereby approved.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 17th day of May, 1983, by the following vote, to wit:

CONDITIONS OF APPROVAL
PP 06-83
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Meandering sidewalk shall tie into curb at north property line and existing sidewalk
at south property line.
6. Three foot high wall shown across easterly end of equestrian easement shall be
deleted.
7. If parking lot lighting is to be installed, detailed lighting plan in compliance with
applicable lighting level standards shall be submitted to city for approval; lights to
be downshining box type with recessed light source with light standards a maximum
of 10 feet high north of the building.
8. An approved trash enclosure shall be provided to satisfaction of city.
Department of Public Works:
9. Dedication of right-of-way to 55 feet from centerline of Monterey Avenue.
10. Installation of curb and gutter at 43 feet from centerline, match -up paving and
sidewalk.
11. The city is proposing to widen Monterey Avenue in fiscal 1983-84. If the city
awards a contract prior to applicant having the street improvements constructed,
the applicant shall reimburse the city for his share based on the contract unit price
plus seven percent for engineering and inspection.
12. Full public improvements, including traffic safety lighting as required by ordinance
and the director of public works, shall be installed in accordance with city
standards.
13. Complete improvement plans and specifications shall be submitted as required by
ordinance to the city engineer for checking approval before construction of any
improvements is commenced. The applicant shall submit "as -built" plans prior to
acceptance of the improvements by the city.
14. This property is in the AO Depth 1' zone as shown on the Flood Insurance Rate
Map. A flood hazard report, as required by Ordinance No. 221 (Flood Damage
Prevention Ordinance) shall be submitted to the public works department. The
report must be approved by the flood review committee prior to issuance of a
building permit.
