A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT AND A CONDITIONAL USE PERMIT TO ALLOW
CONSTRUCTION OF A SENIOR CITIZENS CENTER WITH
RECRATIONAL FACILITIES AT THE NORTHWEST
CORNER OF SAN PASCUAL AVENUE AND CATALINA
WAY.
CASE NO. CUP 09-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 7th day of June, 1983, hold a duly noticed public hearing to consider a request by the
PALM DESERT SENIOR'S ASSOCIATION, INC., for approval of A Negative Declaration of
Environmental Impact and a conditional use permit to allow construction and operation of
a senior citizen's center with recreational facilities on a 3.07 acre site in the R-1 10,000
zone at the northwest corner of San Pascual Avenue and Catalina Way, more particularly
described as APN 627-111-013, 014.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration of Environmental Impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said conditional use permit:
1. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
2. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public
health, safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
4. The proposed conditional use complies with the goals, objectives, and
policies of the City's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Conditional Use Permit 09-83 is hereby granted for reasons
subject to the attached conditions.
3. That a Negative Declaration of Environmental Impact is hereby approved.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of June, 1983, by the following vote, to wit:

CONDITIONS OF APPROVAL
CUP 09-83
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Detailed exterior parking lot lighting plan in compliance with applicable standards
to be submitted to the city for approval; lights to be down -shining box type with
recessed light source and maximum 10 foot high standards, to include bowling
green lighting.
6. Pursuant to municipal code requirements, an agreement be recorded guaranteeing
that the property will voluntarily be a part of any undergrounding district which is
subsequently established by the city including the property in question.
7. A minimum of 58 off-street parking spaces shall be provided in the initial phase of
construction; additional spaces beyond 48 to be provided adjacent to San Pascual
Avenue with driveway moved adjacent to north property line.
8. Existing trees to be saved, if possible, by relocation or retention in existing
location.
9. Aisle adjacent to bus loading area to be widened 5 feet.
10. Approval of this CUP is for initial and future expansion; future phase plans to be
compatible with phase one construction and shall be approved by architectural
commission.
11. Two parcels which make up property shall be consolidated by applicant into one
parcel prior to issuance of building permit.
12. Fencing around bowling green shall be decorative and approved by architectural
commission.
13. Should a parking problem arise in the future prior to installation of additional
parking, the planning commission after review may require that planned additional
spaces be installed and driveway on Catalina Way relocated.
14. A six foot high wall shall be provided along the north and west property lines.
Department of Public Works:
15. Dedication of right-of-way to thirty feet from centerline on both San Pascual

Avenue and Catalina Avenue.
16. Installation of curb and gutter at twenty feet from centerline on Catalina Avenue.
17. Sidewalk shall be installed on San Pascual Avenue and Catalina Way.
18. Full public improvements, including traffic safety lighting as required by ordinance
and the director of public works, shall be installed in accordance with city
standards.
19. Complete improvement plans and specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before construction of any
improvements is commenced. The applicant shall submit "as -built" plans prior to
acceptance of the street improvements by the city.
20. This property is in the AO Depth 1' zone as shown on the Flood Insurance Rate
Map. A flood hazard report, as required by Ordinance No. 221 (Flood Damage
Prevention Ordinance) shall be submitted to the public works department. The
report must be approved by the flood review committee prior to issuance of
building permit.
City Fire Marshal:
21. Install a water system capable of delivering 3000 GPM fire flow for a three (3) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
22. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction from each
hydrant.
23. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department, and the original will be
returned to the developer.
24. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case Number CUP 09-83 is in accordance with the
requirements prescribed by the fire marshal."
25. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
26. Buildings may require an automatic fire sprinkler system.
27. Additional fire protection may be necessary when specific building plans are
submitted for approval.
