HomeMy WebLinkAboutRes No 880PLANNING COMMISSION RESOLUTION NO. 880 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A 28 LOT TENTATIVE TRACT MAP LOCATED WEST OF THE PALM VALLEY STORM CHANNEL NORTH OF THE PALM DESERT COMMUNITY CENTER. CASE NO. TT 19503 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of September, 1983, hold a duly noticed public hearing to consider a request by GEORGE FOX for approval of a 28 lot tentative tract map and Negative Declaration of Environmental Impact to allow the construction of 58 units on 97.5 acres with the hillside planned development drainageway overlay zone located west of the Palm Valley Storm Channel north of the Palm Desert Community Center, more particularly described as: A.P.N. 629-070-014 and 629-070-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons as justified in the staff report for TT 19503 dated September 6, 1983, on file in the department of environmental services, to exist to approve the tentative tract map: 1. As conditioned, the proposed map, its design, improvements, type of development and density are consistent with the State Subdivision Map Act, Palm Desert Subdivision and Zoning Ordinances, General Plan and the West Hills Specific Plan. 2. The design of the subdivision will not result in substantial environmental damage, injure fish or wildlife or result in public health problems. Only 5% of the hillside area will be subject to development. 3. The design will not conflict with public easements. 4. The design will allow unrestricted solar access to all lots. WHEREAS, in the review of this tentative tract map the planning commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That it does hereby approve the above described Tentative Map No. 19503 for the reasons set forth in this resolution and subject to the attached conditions. 3. That a Negative Declaration of Environmental Impact is hereby approved. DIAZ, Secret /pa Y RALPH B. WOOD, Chairman PLANNING COMMISSION RESOLUTION NO. 880 CONDITIONS OF APPROVAL CASE NO. TT 19503 Department of Environmental Services: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. The applicant shall have twenty-four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning commission. 3. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 4. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert or other appropriate agency, without cost and free of all liens and encumbrances. 5. The CC&R'S for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Prior to recordation of the final map the applicant must receive approval of a hillside development plan including final grading and drainage plan and a conceptual landscape plan showing treatment of scarred areas. 7. Prior to submittal of the final map, the applicant shall provide the department of environmental services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of environmental services. City Fire Marshal: 8. Install a water system capable of delivering 1500 GPM fire flow from any hyrdrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 9. Install Riverside County super fire hydrants located at each street intersection. a. Not greater than 500 feet apart in any direction. b. All buildings shall be within 250 feet from a fire hydrant. c. Exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. d. Curbs shall be painted red 15 feet in either direction from each hydrant. 10. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. 11. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in accordance with the requirements prescribed by the fire marshal". Upon arrival, the original plan will be returned to the developer. 12. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. PLANNING COMMISSION RESOULUTION NO. 880 City Fire Marshal's Conditions (Continued): 13. Minimum street width is 28 feet. 14. 40' radius turn-arounds shall be provided as part of each intersection. 15. Buildings shall be set back at 25' from downhill slopes. 16. Each building site shall contain an approved hammerhead turnaround. 17. Slopes of streets shall not exceed 20%. 18. Flood control systems shall be separate from and shall protect vehicle travelways. Department of Public Works: 19. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 20. Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the director of public works. 21. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 22. Improvement plans for water and sewer systems shall be approved by the respective service districts. 23. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before contruction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the city. 24. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 25. Storm drain construction shall be contingent upon a drainage study by the private engineer. 26. Traffic safety stripping on the public streets shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 27. A minimum 200-foot centerline radius for the interior private streets shall be maintained throughout the project, or as approved by the director of public works. 28. All proposed driveway locations shall only be conceptually approved with this development. Final approval shall be done in accordance with the review of each individual site grading plan. 29. The developer shall provide a 24-foot wide paved access from the Green Way Bridge to the southerly tract boundary. 30. A 60-foot right-of-way along the easterly tract boundary shall be dedicated to the city and fully improved to city public street standards based on a 36-foot curb separation. 31. Construction of an approved separation between the Palm Valley Channel and the public street shall be done as required by the city engineer. 32. Interior streets shall be constructed to the City of Palm Desert private street standards per the municipal code. 33. Street and grading plans to be approved by the public works department and a surety posted to guarantee the required improvements prior to recordation of the map. /pa
