A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A 15 LOT TENTATIVE TRACT MAP, HILLSIDE
DEVELOPMENT PLAN AND NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT FOR 33.4 ACRES
LOCATED WEST OF THE PALM VALLEY STORM
CHANNEL AND NORTH OF THE CAT CREEK DEBRIS
BASIN.
CASE NOS. TT 18986 and HDP 01-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 6th day of September, 1983, hold a duly noticed public hearing to consider a request
by FRED C. WHITMAN for a 15 lot tentative tract map, Hillside Development Plan and a
Negative Declaration of Environmental Impact for 33.4 acres located west of the Palm
Valley Storm Channel and north of the Cat Creek Debris Basin, more particularly
described as:
A.P.N'S 631-090-001, 631-120-009, 686-390-027 and 631-070-001
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said planning commission did find
the following facts and reasons as justified in the staff report for TT 18986 and
HDP 01-83, dated September 6, 1983, on file in the department of environmental services,
to exist to approve the tentative tract map:
A. The proposed map, its design, improvements, type of development and
density are consistent with the State Subdivision Map Act, the Palm
Desert Subdivision and Zoning Ordinance, General Plan and the West
Hills Specific Plan.
B. The design of the subdivision will not result in substantial
environmental damage, injure fish or wildlife or result in public
health problems. The development will be similar in type and intensity
to surrounding residential development which has not resulted in
environmental or health problems. Water and sewage improvements will
be approved by the Riverside County Health Department and the Colorado
River Basin's Regional Water Quality Control Board.
C. The design will not conflict with public easements.
D. The design will allow unrestricted solar access to all lots.
WHEREAS, in the review of this tentative tract map the planning commission has
considered the effect of the contemplated action on the housing needs of the region for
purposes of balancing these needs against the public service needs of the residents of the
City of Palm Desert and its environs, with available fiscal and environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case;
2. That it does hereby approve the above described Tentative Map No. 18986
and HDP 01-83 for the reasons set forth in this resolution and subject to the
attached conditions.
3. That a Negative Declaration of Environmental Impact is hereby approved.

Desert Planning Commission, held on this 6th day of September, 1983, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. TT 18986 and HDP 01-83
Department of Environmental Services:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations and restrictions of all municipal ordinances and state and
federal statutes now in force, or which hereafter may be in force.
2. The applicant shall have twenty-four (24) months from the date of the approval or
conditional approval of the tentative map for filing of the final map unless an
extension of time as permitted by code is granted by planning commission.
3. All on -site utilities, including cable TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the director of environmental services.
4. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert or other appropriate agency, without cost and free of all
liens and encumbrances.
5. The CC&R'S for this development shall be submitted to the director of
environmental services for review and final approval by the city attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the city engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into with
the owners of the units of the project.
6. Prior to submittal of the final map, the applicant shall provide the department of
environmental services with a list of proposed street names with at least three
alternatives. The approval of the final street name shall be made by the director of
environmental services.
Department of Public Works:
7. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to the recordation of the final map.
8. Local storm drain construction may be required as determined by the private
engineer's drainage study and grading plan.
9. Full improvements, as required by ordinance and the director of public works, shall
be installed in accordance with city standards.
10. Improvement plans for water and sewer systems shall be approved by the Coachella
Valley Water District.
11. The utilization of on -site sewage disposal is subject to approval of the County of
Riverside Department of Environmental Health and the California Regional Water
Quality Control Board. Percolation tests shall be provided for these agencies and
the city.
12. Complete improvement plans and specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as -built" plans prior to
the release of performance bonds by the city.
13. All private streets shall be inspected by the public works department and the
standard inspection fees shall be paid.
14. The proposed Palm Valley Channel crossing at Donamor Road must be approved by
the Coachella Valley Water District, including the design and construction of the
proposed structure.

15. Proof of legal right utilize the private streets through Indian Springs Mobile
Estates for access shall be submitted to the city engineer.
16. All private streets shall be improved with a minimum of 28 feet of paving (Section
26.44.010 of the municipal code requires that both public and private streets be
paved. In order to permit gravel roads, developer must request special permission
from the City Council).
17. Any proposed storm drain connections to the Palm Valley Channel will require
review and approval of the Coachella Valley Water District.
18. The minimum street centerline radius is 100 feet per city ordinance.
Fire Marshal:
19. Install a water system capable of delivering 1500 GPM fire flow from any hyrdrant
for a two hour duration in addition to domestic supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
20. Install Riverside County super fire hydrants located at each street intersection.
a. Not greater than 500 feet apart in any direction.
b. All buildings shall be within 250 feet from a fire hydrant.
c. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted
green.
d. Curbs shall be painted red 15 feet in either direction from each
hydrant.
21. Prior to recordation of the final map, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review.
22. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in accordance with the requirements prescribed by the fire
marshal". Upon arrival, the original plan will be returned to the developer.
23. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
24. Cul-de-sac minimum turning radius is 40 feet.
25. Streets must be an approved all weather vehicle travel way.
