HomeMy WebLinkAboutRes No 884PLANNING COMMISSION RESOLUTION NO. 884 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW THE CONSTRUCTION OF TWO INDUSTRIAL BUILDINGS TOTALING 40,678 SQUARE FEET AND A LOT CONSOLIDATION ON THE EAST SIDE OF BOARDWALK AT ST. JAMES PLACE IN A SERVICE INDUSTRIAL ZONE AND APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT. CASE NOS. PP 11-83 and PMW 03-83 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of September, 1983, hold a duly noticed public hearing to consider the request of JAMES RODGERS for approval of a precise plan of design and parcel map waiver for the above mentioned project on property more particularly described as: Lots 39 and 40 of TT 13915 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant adverse impact on the environment and that a Negative Declaration of Environmental Impact can be approved therefore. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design and parcel map waiver. 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. The proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other requirements of this title. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 02-83 and PMW 03-83 is hereby granted for reasons subject to the attached conditions. DIAZ, Secretary /pa -2- RALPH B. WOOD, Chairman PLANNING COMMISSION RESOLUTION NO. 884 CONDITIONS OF APPROVAL CASE NOS. PP 11-83 and PMW 03-83 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, unless modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances including but not limited to zoning, building and health codes, as well as state and federal statutes now in force, or which may be in force at the time of development. 3. Construction of this project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect. 4. Prior to the issuance of a building permit for construction the applicant shall obtain any necessary permits and/or clearances from any necessary public agencies including but not limited to: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearances shall be presented to the department of building and safety at the time of issuance of a building permit for the project set forth herein. 5. Trash enclosures location and access shall be approved by Palm Desert Disposal Company prior to the issuance of building permits. 6. Wall and landscape treatment shall be so designed as to diffuse the impact of the walls and be approved by the city's architectural commission. Fire Marshal: 7. Install a water system capable of delivering 4000 GPM fire flow for a four (4) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Built-in fire protection may reduce fire flow requirements. 8. Install Riverside County super fire hydrants so that no point of any building is more than 150 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 9. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 3 PLANNING COMMISSION RESOLUTION NO. 884 Fire Marshal's Conditions (Continued): 10. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in Case Number PP 11-83 and PMW 03-83 is in accordance with the requirements prescribed by the fire marshal". 11. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 12. Fire lanes must be provided with a minimum of 50 foot turning radius around buildings. 13. Trash dumpsters shall not be within 5 feet of walls, building openings or combustible roof eave lines, unless protected by an approved automatic sprinkler system. 14. Buildings shall be protected by an approved automatic fire sprinkler system. Department of Public Works: 15. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before any construction work is commenced. 16. Landscaping maintenance on Boardwalk shall be provided by the owners. 17. Issuance of all permits, excluding stockpile, shall be done after recordation of the necessary parcel map waiver. 4
