HomeMy WebLinkAboutRes No 888PLANNING COMMISSION RESOLUTION NO. 888 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND PARCEL MAP WAIVER TO ALLOW THE CONSTRUCTION OF A RETAIL COMMERCIAL BUILDING LOCATED BETWEEN THE FRONTAGE ROAD AND ALESSANDRO AND ON PROPERTY ON THE NORTH SIDE OF ALESSANDRO 370 FEET EAST OF PORTOLA. CASE NOS. CUP 18-83 and PMW 04-83 WHEREAS, the planning commission of the City of Palm Desert, California, did on the 20th day of September, 1983, hold a duly noticed public hearing to consider a request by CHESTER DORN, 73-242 Joshua Tree, Palm Desert, CA 92260, for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a Class 2 categorical exemption for purposes of CEQA and no further documentation is necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said conditional use permit and parcel map waiver: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives and policies of the city's general plan. 5. The poposed lot line adjustment (parcel map waiver) and the resulting parcels will comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate disposal facilities and water supply availability. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 18-83 and Parcel Map Waiver 04-83, is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert PLANNING COMMISSION RESOLUTION NO. 888 Planning Commission, held on this 20th day of September, 1983, by the following vote, to wit: AYES: CRITES, DOWNS, ERWOOD, RICHARDS, WOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE RALPH B. WOOD, Chairman ATTEST: RAMON A. DIAZ, Secret. y /pa PLANNING COMMISSION RESOLUTION NO. 888 CONDITIONS OF APPROVAL CASE NOS. CUP 18-83 and PMW 04-83 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Community Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. That the proposed storage area on the north part of the R-3 zoned property on the north side of Alessandro be deleted. 6. That a six foot high block wall be installed on the east, west and north property lines of the R-3 zoned property on the north side of Alessandro. 7. That a minimum 10 foot wide, heavily planted landscape buffer be provided along the north end of the parking lot (i.e. the north part of the property on the north side of Alessandro. 8. That a three foot wall be provided along the Alessandro property line to screen the parking area. 9. That the proposed storage area adjacent to the loading area be adequately screened from view to comply with code. The method of screening to be reviewed and approved by the architectural commission. Department of Public Works: 10. Dedication of right-of-way to 30 feet from centerline on Alessandro. This shall be done prior to the issuance of any permits. 11. A grading plan prepared by a registered civil engineer shall be submitted and approved prior to any construction. 12. Landscaping maintenance on Alessandro shall be provided by the owner. Fire Marshal: 13. General fire protection has previously been met in this parcel. Additional fire protection requirements will be necessary when specific building plans are submitted for a building permit. 14. An additional exit to the exterior is required from the second floor. Exit doors shall swing in the direction of egress.
