A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
AN AMENDMENT TO A DEVELOPMENT PLAN FOR A
REGIONAL SHOPPING CENTER LOCATED AT THE
NORTHEAST CORNER OF EL PASEO AND HIGHWAY

CASE NO. DP 12-79 (AMENDMENT #3)
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 18th day of October, 1983, hold a duly noticed public hearing to consider a request by
PALM DESERT TOWN CENTER ASSOCIATES for approval of an amendment to a
development plan to allow construction of a TBA store in the Palm Desert Town Center in
the PC (3) S.P. zone, located at the norhtwest porton of the Palm Desert Town Center.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and was
previously assessed.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts to justify their actions, as described below:
1. The proposed project generally conforms to the intent and purpose of the PC
(3) zone district.
2. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
3. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public
health, safety, or general welfare, or be materially injurious to properties or
improvements in the vicinity.
4. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
5. The proposed conditional use complies with the goals, objectives, and
policies of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That the Planning Commission does hereby approve Conceptual
Development Plan No. 12-79 (Amendment ##3) subject to those conditions
attached hereto.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 18th day of October, 1983, by the following vote, to
wit:

CONDITIONS OF APPROVAL
CASE NO. DP 12-79 (AMENDMENT #3)
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to allow
Municipal Ordinances and state and federal statutes now in force, or which
hereafter may be in force.
3. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
4. All previous conditions of approval which apply to this property shall be met.
5. The TBA building shall be designed as a contained structural unit with no service
bay openings exposed to the exterior; additional landscaping shall be provided to
screen those service bay openings.
6. This amendment reduces the square footage approved for the future department
store to 50,000 square feet until additional parking is provided.
Department of Public Works:
7. Complete grading plans and specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before construction of any
improvements is commenced.
8. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
9. Landscaping maintenance on El Paseo shall be provided by the owner.
10. Driveway construction shall conform to the City of Palm Desert Design Criteria
for commercial driveways and shall be as specified on the approved grading plan
only.
Fire Marshal:
11. Install a water system capable of delivering 3000 GPM fire flow for a three (3) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
12. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.

c. Curbs (if installed) shall be painted red 15 feet in either direction from each
hydrant.
13. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department, and the original will be
returned to the developer.
14. The water system plan shall be signed by a registered civil enginer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case Number DP 12-79 No. 3 is in accordance with the
requirements prescribed by the fire marshal."
15. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
