HomeMy WebLinkAboutRes No 902PLANNING COMMISSION RESOLUTION NO. 902 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW THE CONSTRUCTION OF INDUSTRIAL BUILDINGS TOTALLING 10,400 SQUARE FEET AND A LOT CONSOLIDATION ON THE WEST SIDE OF ECLECTIC STREET NORTH OF 42ND AVENUE IN A SERVICE INDUSTRIAL ZONE AND APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT. CASE NOS PP 16-83 and PMW 06-83 WHEREAS, the planning commission of the City of Palm Desert, California, did on the 15th day of November, 1983, hold a duly noticed public hearing to consider the request of CABAK, RANDALL, JASPER, GRIFFITH ASSOCIATES, for approval of a precise plan of design and parcel map waiver for the above mentioned project on property more particularly described as: Parcels 1, 2 and 3 of Parcel Map 18831 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant adverse impact on the environment and that a Negative Declaration of Environmental Impact can be approved therefore. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design and parcel map waiver. 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. The proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other requirements of this title. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 16-83 and PMW 06-83 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert PLANNING COMMISSION RESOLUTION NO. 902 Planning Commission, held on this 15th day of November, 1983, by the following vote, to wit: AYES: CRITES, ERWOOD, RICHARDS, WOOD NOES: NONE ABSENT: DOWNS ABSTAIN: NONE ATTEST: 0.4 AMON A. DIAZ, Secretary /pa -2 /?1 RALPH B. WOOD, Chairman PLANNING COMMISSION RESOLUTION NO. 902 CONDITIONS OF APPROVAL CASE NOS. PP 16-83 and PMW 06-83 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, unless modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of this project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. That a vehicle turnaround circle be provided at the end of the visitor/office parking lot. Department of Public Works: 6. Full half -street public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standardards for a private street. 7. Improvement plans for water and sewer systems shall be approved by the respective service districts. 8. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the city. 9. A certificate of compliance shall be completed and approved prior to issuance of any building permits. 10. Landscaping maintenance on Eclectic and the private street shall be provided by the owners. 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to the issuance of building permits. 12. Prior conditions for PM 17452 to be followed per June 23, 1981. 13. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before issuance of the building permits. -3 PLANNING COMMISSION RESOLUTION NO. 902 14. Offsite improvement plans to be approved by the public works department and a surety posted to guarantee the required offsite improvements prior to building permits being issued. 15. The size, number and location of driveway approaches shall be to public works department specifications. Fire Marshal: 16. Paint shop must be protected by an automatic fire sprinkler system and shall meet all provisions of the Uniform Fire Code, Article 45 - Spray Finishing. 17. Fuel storage and dispensing must meet minimum standards of the Uniform Fire Code, Article 79. Plans must be approved prior to installation. 18. South driveway must have an alternate access or 40' radius turnaround. Alternate access also required for main parking/facility yard. 19. Additional fire protection requirements may be necessary when specific building plans are submitted for approval. -4
