HomeMy WebLinkAboutRes No 906PLANNING COMMISSION RESOLUTION NO. 906 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM R-3 18,000 (3) S.P. TO PC (4) S.P. FOR PROPERTY LOCATED 100 FEET SOUTH OF EL PASEO, BETWEEN HIGHWAY 74 and OCOTILLO DRIVE. CASE NO. C/Z 07-83 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of December, 1983, hold a duly noticed public hearing to consider the request of ARCH DEVELOPMENT CORPORATION for approval of a Negative Declaration of Environmental Impact and a change of zone from R-3 18,000 (3) S.P. (Multiple family, minimum 18,000 sq.ft. lot size, maximum one dwelling unit per 3000 sq.ft. of lot size, with a scenic preservation overlay) to PC (4) S.P. (Planned Resort Commercial, with a scenic preservation overlay), on 6.9 acres located 100 feet south of El Paseo, between Highway 74 and Ocotillo Drive (area including and between Adobe Garden Hotel and Carousel Resort Hotel), more particularly described as: APNs 627-231-010, 627-281-008, 001, 012 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have any adverse environmental impact and a Negative Declaration of Environmental Impact is recommended. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify their actions, as described below: 1. The land use resulting from the change of zone would be compatible with adjacent proposed land uses. 2. The density resulting from the change of zone would be compatible with densities permitted in the adjacent areas. 3. The proposed change of zone would be compatible with the adopted Palm Desert General Plan. 4. The proposed change of zone will allow development of a project which is compatible with adjacent properties and the adopted Palm Desert General Plan. 5. The PC (4) zone restricts uses and contains development standard which provide compatibility with residential properties. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in these cases; 2. That the Planning Commission does hereby recommend to the City Council approval of a change of zone from R-3 18,000 (3) S.P. to PC (4) S.P. per attached Exhibit A. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of December, 1983, by the following vote, to wit: AYES: DOWNS, ERWOOD, RICHARDS, WOOD NOES: CRITES ABSENT: NONE ABSTAIN: NONE f RALPH B.
