HomeMy WebLinkAboutRes No 0937PLANNING COMMISSION RESOLUTION NO. 937 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF AN 8648 SQ.FT. BUILDING AT THE SOUTHWEST CORNER OF MEDITERRANEAN AND BEACON HILL. CASE NO. PP 84-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of March, 1984, hold a duly noticed public hearing to consider the request of BOB SANDIFER for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant effect on the environment and a Negative Declaration of Environmental Impact is hereby approved as part of this resolution. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 84-2 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of March, 1984, by the following vote, to wit: AYES: CRITES, DOWNS, ERWOOD, RICHARDS, WOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: MON A. DIAZ, Secreta /lr /3 /-,),.„C__,) RALPH B. WOOD, Chairman -1- PLANNING COMMISSION RESOLUTION NO. 937 CONDITIONS OF APPROVAL Case No. PP 84-2 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Provide a landscaped area two feet in width adjacent to the westerly wall in the rear yard. 6. Install either a vine covered chainlink fence or a 42" wood fence along the rear property line adjacent to parking area with a two foot minimum width of planter area. 7. Trash enclosure site to be approved through final architectural review. 8. Applicant shall be allowed one compact car stall at extreme westerly end of parking area in the rear of the site. The space shall be clearly marked indicating it is compact car stall. Fire Marshal: 9. The minimum fire flow requirement is 3000 GPM for a duration of 3 hours in addition to the calculated average domestic use. The design of the water system must be certified to meet the required fire flow by registered civil engineer. 10. The fuel piping, dispenser and tank plans must be approved prior to installation and meet the minimum standards of the Uniform Fire Code (1979) Article 79. 11. Additional fire protection requirements maybe necessary when specific building plans are submitted for approval. 12. One -hour exterior wall construction within 10 feet of any trash enclosure. Department of Public Works: 13. Landscaping maintenance on Mediterranean and Beacon Hill shall be provided by the owners. 14. Complete grading plans and specifications shall be submitted, as required by -2- PLANNING COMMISSION RESOLUTION NO. 937 ordinance, to the city engineer for checking and approval prior to issuance of any permits. 15. Size, number and location of driveways to public works specifications. 16. Only two driveway approaches will be allowed to serve this property. Size and location to public works specifications. 17. Reciprocal driveway easement (twelve feet wide) to be deeded on the west property line prior to grading permit issuance. /lr -3-
