HomeMy WebLinkAboutRes No 0953PLANNING COMMISSION RESOLUTION NO. 953 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM PR-3 TO PR-5. CASE NO. C/Z 84-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of June, 1984, hold a duly noticed public hearing to consider the request of WATT INDUSTRIES/PALM SPRINGS INC. for approval of a change of zone from PR-3 (planned residential, maximum 3 dwelling units per acre) to PR-5 (planned residential, maximum 5 units per acre) for 38.6 acres located on the north side of Mesa View Drive, east of Alamo Drive, more particularly described as: TRACTS 13581, 13581-1, and 13581-2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify their actions, as described below: 1. The proposed PR-5 (planned residential, maximum 5 dwelling units per acre) is in compliance with the general plan land use element, which indicates the property as low density residential 3 to 5 dwelling units per acre. 2. The proposed zoning of PR-5 is the same as existing zoning to the west and less intense than the existing zoning (PR-7) to the south. 3. The project proposed to be constructed, if this change of zone is approved, shows that the site can be developed in a manner which is acceptable to the city without significant negative affects on adjoining properties. 4. The undeveloped nature of the site tends to provide an eyesore in the vicinity and the unimproved adjacent streets impede proper and safe traffic circulation. The rezoning to PR-5 will allow a project which will improve the aesthetics in the neighborhood, improve traffic circulation and safety, and not depreciate property values or detrimentally affect the health, safety, or welfare of persons in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in these cases; 2. That the planning commission does hereby recommend to the city council approval of a change of zone from PR-3 to PR-5, as shown on attached Exhibit "A." 3. That a negative declaration of environmental impact is hereby recommended for approval.
