HomeMy WebLinkAboutRes No 0954PLANNING COMMISSION RESOLUTION NO. 954 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF A 175 UNIT CONDOMINIUM PROJECT ON THE NORTH SIDE OF MESA VIEW DRIVE, EAST OF ALAMO DRIVE. CASE NO. PP 84-15 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of June, 1984, hold a duly noticed public hearing to consider a request by WATT INDUSTRIES/PALM SPRINGS INC. for approval of a precise plan of design to allow construction of a 175 unit condominium project on 38.6 acres in the PR-3 zone (change of zone to PR-5 pending) located on the north side of Mesa View Drive, east of Alamo Drive, more particularly described as: TRACTS 13581, 13581-1, and 13581-2. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 84-15 is hereby granted for reasons subject to the attached conditions. 3. That a negative declaration is hereby approved. DIAZ; Secretary /tm -� ( — BUFORD CRITES, Chairman PLANNING COMMISSION RESOLUTION NO. 954 CONDITIONS OF APPROVAL Case No. PP 84-15 Department of Environmental Services: 1. The development of the property shall conform subtantially with Exhibits (Case No. PP 84-15) on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, design review, subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the city could consider each phase as a single project. 4. Construction of a portion of said project shall commence within two years from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void, and of no effect whatsoever. 5. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all Municipal Ordinances and state and federal statutes now in force, or which hereafter may be in force. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 7. Subdivision to be provided with minimum six foot high wall/fence around project (except for approved openings and adjacent to CVWD site); plan for wall/fence to be approved by city prior to issuance of building permit. 8. Applicant shall coordinate provisions for mail service with Palm Desert Branch of U.S. Postal Service. 9. Approval of project is subject to property being rezoned to PR-5 or other appropriate zone. 10. Exceptions to PR zone requirements as noted in staff report are approved. 11. Parking bays shall be 9 feet by 28 feet. 12. Project entrance on Mesa View Drive to be designed so that rejected vehicles can leave in forward direction. 13. Wall and tennis courts adjacent to Alamo Drive shall be setback an additional 5 feet from street property line. -2- PLANNING COMMISSION RESOLUTION NO. 954 14. All units shall be provided with minimum 20 foot deep driveway apron. 15. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are on or adjacent to the property being developed shall be installed underground, if practicable, as a part of development from the nearest existing pole not on the property being developed. 16. All tennis court lighting not to exceed 20 feet in height and shall be down -shining box type; all court lighting to be provided with shields to restrict visibility of light source to all sides. Tennis court lighting to be restricted to no later than 10 p.m. 17. Driveway or street to Alamo Drive to be "exit only" except during construction; traffic provisions to insure exit only to be approved by city prior to issuance of building permit. 18. Pad and street elevations to be designed to minimize impact on existing houses to east; detailed grading plan for area to be approved by city prior to issuance of grading permit. 19. "No parking (except in designated spaces)" shall be posted on 28 foot wide private streets. 20. All dwelling units adjacent to Mesa View Drive shall be setback a minimum 20 feet from street property line. 21. All perimeter wall/fences shall be installed with first phase. 22. Emergency access to Arrow Trail to be eliminated. 23. Street plan map directory shall be provided at entry to direct emergency vehicles. Department of Public Works: 24. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 25. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. 26. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 27. Full public improvements, including traffic safety lighting as required by ordinance and the Director of Public Works, shall be installed in accordance with city standards. 28. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the city. 29. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 30. Landscaping maintenance on Alamo Drive and Mesa View Drive shall be provided by the homeowners' association. 31. Existing utilities on Arrow Trail and Alamo Drive shall be undergrounded. 32. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. -3- PLANNING COMMISSION RESOLUTION NO. 954 33. Dedication of 24 feet of right-of-way on Mesa View Drive shall be done prior to issuance of any permits and approval of plans, unless already dedicated with TR 13581. 34. Installation of curb and gutter at 32 feet from centerline, matching paving and sidewalk on Mesa View Drive. 35. Offsite improvement plans to be approved by the Public Works Department and a surety posted to guarantee the required offsite improvements prior to the map recording. 36. Full improvement of interior streets based on private street standards shall be provided. 37. Installation of sewers to serve this project. 38. Size, number and location of driveways to Public Works specifications. 39. Only two driveway and one emergency driveway approaches will be allowed to serve this property. Size and location to Public Works specifications. 40. Installation of curb and gutter at twenty feet from centerline, matching paving and sidewalk on Alamo Drive. 41. Installation of curb and gutter at eighteen feet from centerline, and matching paving on Arrow Trail. 42. Installation of median curb and landscaping on Mesa View Drive median. 43. Preparation of a traffic analysis to determine impact of development upon Alamo Drive off -site; if deemed necessary by the city, the applicant shall install curb, gutter, and tie-in paving on the east side of Alamo Drive between Homestead and Bel Air. City Fire Marshal: 44. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 45. Install Riverside County super fire hydrants located at each intersection: a. but not greater than 500 feet apart in any direction. b. so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. c. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. d. curbs shall be painted red 15 feet in either direction from each hydrant. e. hydrants shall not be located closer than 25 feet to any building. 46. Prior to recordation of the final map, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. 47. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. -4- PLANNING COMMISSION RESOLUTION NO. 954 48. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-15, TT 20102, C/Z 84-6 is in accordance with the requirements prescribed by the Fire Marshal." 49. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 50. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 51. Twenty-eight foot wide streets will not permit any on -street parking. -5-
