A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A CONDITIONAL USE PERMIT ALLOWING CONVERSION
OF A RESIDENCE TO A DENTAL OFFICE IN THE R-2
ZONE LOCATED AT THE NORTHEAST CORNER OF SAN
GORGONIO WAY AND MONTEREY AVENUE.
CASE NO. CUP 84-4
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 5th day of June, 1984, hold a duly noticed public hearing to consider a request by
JOHN R. HORNICK, D.D.S. for approval of a conditional use permit to allow conversion
of a residence to a dental office in the R-2 zone located at 44-740 Monterey Avenue,
more particularly described as APN 627-061-010.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a Class 3 categorical exemption and therefore no further documentation is
deemed necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said conditional use permit:
1. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
2. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public
health, safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
4. The proposed conditional use complies with the goals, objectives, and
policies of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Conditional Use Permit 84-4 is hereby granted for reasons
subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of June, 1984, by the following vote, to wit:

CONDITIONS OF APPROVAL
Case No. CUP 84-4
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the procedural
requirements of the city which include, but are not limited to, architectural review
and building permit procedures.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to allow
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Construction of said project shall commence within one year from the date of final
approval unless an extension of time is granted; otherwise said approval shall
become null, void and of no effect whatsoever.
5. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
or business license for the use contemplated herewith.
6. In lieu of undergrounding existing utility distribution lines at rear of property as a
part of construction, the applicant shall record an agreement prior to issuance of
business license or building permit guaranteeing that the property will voluntarily
be a part of any undergrounding district which is subsequently established by the
city including the property in question.
7. Service lines from power poles to structure to be placed underground prior to the
commencement of the business.
8. Architectural commission shall review and approve landscaping plan and exterior
paint scheme; landscaping to be extensively upgraded in all areas.
9. 6 foot high block wall shall be constructed along east property line to replace wood
fence, prior to commencement of the business.
10. The property shall not be used for residential purposes once converted to a dental
office.
11. Garage spaces shall be available and used for on site parking for employees.
12. Westerly driveway shall be reduced in width to 20 feet.
13. Three foot high block screen wall shall be constructed to shield view of parking
area from street prior to commencement of the business; with screen wall in front
of site repaired.
14. Trash enclosure shall be provided, location subject to approval of city and local
disposal company.

Department of Public Works:
15. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to recordation of the final map.
16. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the director of public works.
17. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
18. Complete improvement plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval before construction of
any improvements is commenced. The subdivider shall submit "as -built" plans prior
to acceptance of the subdivision improvements by the city.
19. Landscaping maintenance on Monterey Avenue and San Gorgonio Way shall be
provided by the owner.
20. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
21. Installation of curb and gutter at 18 feet from centerline, matching paving and
sidewalk on San Gorgonio Way.
22. Offsite improvement plans to be approved by public works department and a surety
posted to guarantee the required offsite improvements prior to building permits
being issued.
23. Size, number and location of driveways to public works specifications.
24. Only 2 driveway approaches will be allowed to serve this property. Size and
location to public works specifications.
