HomeMy WebLinkAboutRes No 0963PLANNING COMMISSION RESOLUTION NO. 963 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO CREATE TWO PARCELS ON THE SOUTH SIDE OF FRED WARING DRIVE BETWEEN EL PASEO AND FAIRHAVEN DRIVE. CASE NO. PM 19978 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed public hearing on the 19th day of June, 1984, to consider the request of ERNEST W. HAHN for approval of a parcel map to divide one lot into two parcels in the PR-6, S.P. (change of zone to PC (3) S.P. pending on portion of site) located on the south side of Fred Waring Drive between El Paseo and Fairhaven Drive, more particularly described as: Parcel 3, Parcel Map 15723 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project has been previously assessed in connection with Case Nos. C/Z 08-79, DP 12- 79, and CUP 06-79 and no further documentation is deemed necessary. WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the parcel map: 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 19978 subject to fulfillment of the attached conditions. Parcel Map 19978 is granted for the land as described in the attachments hereto, and as shown on exhibits on file with the department of environmental services and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the state, city and any other applicable government entity, shall be complied with as a part of this map. 3. Pursuant to municipal code requirements, tentative parcel map shall be recorded within two years from date of approval, unless an extension of time is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. Parcel 1 shall be consolidated with town center site to south. 5. Approval of the parcel map shall be subject to approval of C/Z 84-10 by city council. 6. A parking lot/wall and landscaping plan shall be submitted to the city for approval prior to any use of construction or grading of the property. Department of Public Works: 7. Property owner shall dedicate a 15 foot easement for storm drain purposes across Parcel 2 and the westerly 10' of parcel 1 to the satisfaction of the director of public works.
