HomeMy WebLinkAboutRes No 0972WNW Imo PLANNING COMMISSION RESOLUTION NO. 972 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE USE OF AN EXISTING STRUCTURE FOR A PROFESSIONAL OFFICE ON THE SOUTH SIDE OF LARREA 135 FEET WEST OF LANTANA IN AN R-3 ZONE. CASE NO. CUP 84-5 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of July, 1984, hold a duly noticed public hearing to consider a request by HOUSLEY ASSOCIATES for above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant impact and a Negative Declaration is hereby approved. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 84-5 is hereby granted for reasons subject to the attached conditions. DIAZ, Secretary /lr RICHARD ERWOOD, Vice Chairman PLANNING COMMISSION RESOLUTION NO. 972 CONDITIONS OF APPROVAL Case No. CUP 84-5 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to architectural review and building permit procedures. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to allow municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: City Fire Marshal 6. Landscaping shall be provided along Larrea Street at a depth of 6 feet with landscape screening at a height of 42 inches in this area. 7. Applicant shall provide an easement for ingress and egress onto Larrea in favor of the adjacent property to the east located along the easterly 12 feet of the property parallel to the property line. Department of Public Works: 8. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 9. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. 10. Landscaping maintenance on Larrea shall be provided by the owner. 11. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 12. Installation of curb and gutter at 18 feet from centerline, matching paving and sidewalk on Larrea. 13. Off -site improvement plans to be approved by public works department and a surety posted to guarantee the required off -site improvements prior to building permits being issued. 14. Size, number, and location of driveways to public works specifications. 15. Only two driveway approaches will be allowed to serve this property. Size and location to public works specifications. -2-
