HomeMy WebLinkAboutRes No 0984PLANNING COMMISSION RESOLUTION NO. 984 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM R-1 12,000 to PR-5. CASE NO. C/Z 84-12 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 4th day of September, 1984, hold a duly noticed public hearing to consider a request by McBAIL COMPANY for approval of a change of zone from R-1 12,000 (single family zone requiring minimum 12,000 square foot lots) to PR-5 (planned residential, maximum five units per acre) for 58+ acres located at the southwest corner of Country Club Drive and Portola Avenue, more particularly described as: APN'S 622-020-007 622-020-037 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said commission did find the following facts to justify its actions, as described below: 1. The proposed PR-5 (planned residential, maximum 5 dwelling units per acre) is in compliance with the general plan land use element, which delineates the property as low density residential 3 to 5 dwelling units per acre. 2. The proposed PR-5 zoning is the same as existing zoning to the west and south and less intense than the existing use to the north and only slightly higher than the PR-4 to the east. 3. The project proposed to be constructed, if this change of zone is approved, shows that the site can be developed in a manner which is acceptable to the city without signficant negative affects on adjoining properties. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the planning commission does hereby recommend to the city council approval of a change of zone from R-1 12,000 to PR-5, as shown on attached Exhibit "A." 3. That a negative declaration of environmental impact is hereby recommended for approval. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 4th day of September, 1984, by the following vote, to wit: AYES: DOWNS, ERWOOD, RICHARDS, WOOD, AND CRITES NOES: NONE ABSENT: NONE ABSTAIN: NONE �� ',7 BUFORD CRITES, Chairman ATTEST: MON A.
