A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING APPROVAL OF A NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT AND A 58
LOT TENTATIVE TRACT MAP LOCATED WEST OF THE
PALM VALLEY STORM CHANNEL NORTH OF THE PALM
DESERT COMMUNITY CENTER.
CASE NO. TT 19503
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 3rd day of August, 1984, hold a duly noticed public hearing and continued public
hearings on August 7, September 4 and 18, 1984, to consider a request by GEORGE FOX
for approval of a 58 lot tentative tract map and Negative Declaration of Environmental
Impact to allow the construction of 58 units on 97.5 acres within the hillside planned
development, drainageway overlay zone, located west of the Palm Valley Storm Channel
north of the Palm Desert Community Center, more particularly described as:
APN'S 640-100-001, 002
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89," in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a negative
declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said planning commission did find
the following facts and reasons as justified in the staff report for TT 19503 dated
September 6, 1983, on file in the department of environmental services, to exist to
recommend approval of the tentative tract map:
1. As conditioned by the associate development agreement the proposed map,
its design, improvements, type of development and desnity are consistent
with the State Subdivision Map Act, Palm Desert Subdivision and Zoning
Ordinances, General Plan and the West Hills Specific Plan.
2. The design of the subdivision will not result in substantial environmental
damage, injure fish or wildlife or result in public health problems.
3. The design will not conflict with public easements.
4. The design will allow unrestricted solar access to all lots.
WHEREAS, in the review of this tentative tract map the planning commission has
considered the effect of the contemplated action on the housing needs of the region for
purposes of balancing these needs against the public service needs of the residents of the
City of Palm Desert and its environs, with available fiscal and environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case;
2. That it does hereby recommend for approval to city council Tentative Map
No. 19503 for the reasons set forth in this resolution and subject to the
attached conditions.
3. That a Negative Declaration of Environmental Impact is hereby approved.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 2nd day of October, 1984, by the following vote, to wit:
