HomeMy WebLinkAboutRes No 0993PLANNING COMMISSION RESOLUTION NO. 993 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A GENERAL PLAN AMENDMENT AND CHANGE OF ZONE FROM MEDIUM DENSITY RESIDENTIAL AND R-2 (7) and R-2 (7) S.P TO OFFICE PROFESSIONAL (OP), ASSOCIATED STREET VACATION, AND A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION OF A 21,000 SQUARE FOOT PROFESSIONAL OFFICE BUILDING AT THE SOUTHEAST CORNER OF MONTEREY DRIVE AND FRED WARING AVENUE. CASE NOS. GPA 84-02, C/Z 84-13, SANTA ROSA STREET VACATION WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of October, 1984, hold a duly noticed public hearing to consider the request of MONTEREY PARTNERSHIP for approval of a general plan amendment and change of zone from medium density residential, R-2 (7) S.P. to office professional; the vacation of 65' of public street right-of-way, a negative declaration of environmental impact to allow construction of a 21,000 square foot professional office building on the southeast corner of Monterey Drive and Fred Waring Avenue. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts to exist to justify their actions: 1. Due to increasing severe traffic impacts in the area, development of the property under the current residential designation would be contrary to the health and general welfare of the citizens of Palm Desert. 2. The proposed Office Professional use is consistent with goals and objectives of the Palm Desert General Plan Zoning Ordinance and COD Specific Plan. 3. The public right-of-way requested for vacation no longer serves a public purpose. It will be consistent with the Circulation Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. GPA 84-02 (Exhibit "A"), C/Z 84-13 (Exhibit "B"), the Santa Rosa Street Vacation (Exhibit "C"), and a Negative Declaration of Environmental Impact are recommended for approval. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of October, 1984, by the following vote, to wit: AYES: DOWNS, ERWOOD, WOOD, AND CRITES NOES: NONE ABSENT: RICHARDS ABSTAIN: NONE BUFOR CRITES, Chairman ATT (g!vy7/` RAMON A.
