A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN AND LOT LINE
ADJUSTMENT TO ALLOW A COMMERCIAL BUILDING
AT THE NORTHWEST INTERSECTION OF HIGHWAY 111
AND PAINTERS PATH.
CASE NO. PP 84-34 and PMW 84-14
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 18th day of September, 1984, hold a duly noticed public hearing and continued public
hearing on October 16, 1984, to consider the request of GENE SALLY (for P.D. 111, Inc.)
for approval of a precise plan of design and lot line adjustment between two lots to allow
construction of a 19,000 square foot commercial building on the C-1 zone on 1.2 acres
located at the northwest intersection of Highway 111 and Painters Path, more particularly
described as:

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse impact on the environment and a negative declaration
has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 84-34 and Parcel Map Waiver 84-14 is hereby
granted for reasons subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 16th day of October, 1984, by the following vote, to
wit:

CONDITIONS OF APPROVAL
PP 84-34 and PMW 84-14
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the :following
conditions.

2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. If parking lot lighting is to be installed, detailed lighting plan in compliance with
applicable lighting level standards shall be submitted to city for approval; lights to woo
be downshining box type with recessed light source.
6. All undeveloped portions of property shall remain undisturbed unless owner
receives prior planning commission approval.
7. All cut locations to be treated with eonite to retain natural appearance of rocks.
8. 5000 square feet of ground floor rental area shall be limited to furniture uses; no
parking variances shall be granted to allow uses which require more parking.
9. A covenant, approved by the city attorney, shall be recorded dedicating all
development rights to the city for that area indicated as "mountain area" on
approved site plan prior to issuance of a building permit.
10. Prior to issuance of building permit, an existing topography plan showing toe of
slope shall be submitted to the department of environmental services to verify that
encroachment of development does not exceed that shown on approved site plan;
parking lot and building closest to toe of slope to be superimposed on topography
plan.
11. Employee parking area to be signed as such to satisfaction to department of
environmental services.
12. Building height to comply with 30 foot high maximum.
13. All conditions of Caltrans shall be met.
Department of Public Works:
14. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to issuance of grading permit.

15. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the Director of Public Works.
16. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
17. Full public improvements, including traffic safety lighting, as required by
ordinance and the director of public works, shall be installed in accordance with
city standards.
18. Complete improvement plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval before construction of
any improvements is commenced. The subdivider shall submit "as -built" plans prior
to acceptance of the improvements by the city.
19. Landscaping maintenance on Hwy 111/Painters Path shall be provided by the
owners.
20. Traffic safety striping on Hwy 111 shall be provided to the specifications of the
director of public works. A traffic control plan must be submitted to and approved
by the director of public works before placing pavement markings.
21. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
22. Dedication of 5 feet of right-of-way on Hwy 111 shall be done prior to issuance of
any permits and approval of plans or per Caltrans requirements.
23. Installation of curb and gutter matching paving and sidewalk on Hwy I 1 1 and
Painters Path. This may include a modified curb return on the northwest corner to
address interim deceleration land concerns.
24. Offsite improvement plans to be approved by public works department and a Surety
posted to guarantee the required offsite improvements prior to building permits
being issued.
25. Installation of one-half landscaped median in Hwy 111 or cash payment for one-half
the cost of landscaped median at the option of the director of public works.
26. Size, number and location of driveways to public works specifications.
27. Only one driveway approach will be allowed to serve this property. Size and
location to public works specifications.
City Fire Marshal:
28. Install a water system capable of delivering 3000 GPM fire flow from any fire
hydrant for a three (3) hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure in
the supply main from which the flow is measured at the time of measurement.
Fire flow requirements will depend on built-in fire protection provisions of
buildings.
29. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. Exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. Curbs shall be painted red 15 feet in either direction from each hydrant.
c. Hydrants shall not be located closer than 25 feet to any building.

30. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department, and the original will be
returned to the developer.
31. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in PP 84-34, PMW 84-14, is in accordance with requirements
prescribed by the fire marshal."
32. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
33. An approved monitored automatic fire sprinkler system will be required on all
buildings over 12,000 square feet.
34. Additional fire protection requirements may be necessary when the applicant
submits specific plans for considertion and approval.
35. Fire lanes will be required.
