HomeMy WebLinkAboutRes No 1006PLANNING COMMISSION RESOLUTION NO. 1006 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW THE CONVERSION OF AN EXISTING RESIDENTIAL STRUCTURE TO A CHURCH USE ON 6 LOTS LOCATED AT THE SOUTHWEST CORNER OF PORTOLA AVENUE AND FRED WARING DRIVE. CASE NO. CUP 84-9 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3Oth day of October, 1984, hold a duly noticed public hearing to consider the request by VALLEY CHRISTIAN ASSEMBLY for approval of a condi- tional use permit and negative declaration of environmental impact allowing the conversion of an existing 4,000 square foot residential structure to a church use on 6 lots at the southwest corner of Portola Avenue and Fred Waring Drive. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts to exist to justify their actions: 1. The use of the property as a church is compatible with the surrounding uses and will not be detrimental to the public health, safety or welfare. 2. The proposed church use is consistent with goals and objectives of the Palm Desert General Plan, Zoning Ordinance and COD Specific Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. CUP 84-9 and negative declaration of environmental impact are hereby approved subject to attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3Oth day of October, 1984, by the following vote, to wit: AYES: Downs, Erwood, Wood and Crites NOES: Richards ABSENT: None ABSTAIN: None RD CRITES , Chairman ATTEST: PLANNING COMMISSION RESOLUTION NO. 1006 CONDITIONS OF APPROVAL CASE NO. CUP 84-9 DEPARTMENT OF ENVIRONMENTAL SERVICES 1. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural review and building permits. 2. The development of the property shall conform with all approved exhibits on file with the department of environmental services, to all municipal, state, and federal statutes now in force or which hereafter may be in force. 3. Construction of required parking lot and cosmetic landscape upgrading including removal of dead plant material and installation of turf in major bare areas shall occur prior to occupancy. Within 6 months applicant shall either submit to planning commission a precise plan for new building construction or submit complete landscape and arch- itectural upgrading plans for the existing improvements to the arch- itectural commission. In either case, construction shall begin within one year from the date of this approval. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District 5. Provisions for mail service shall be coordinated with the Palm Desert. Brand U.S. Postal Service. 6. Location and design of trash enclosures shall be coordinated with Palm Desert Disposal Company. 7. Prior to the issuance of any building or grading permits, applicant shall submit and gain approval of a parcel map or parcel map waiver consolidating all parcels involved in the proposed construction. PUBLIC WORKS CONDITIONS 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Landscaping maintenance on Fred Waring/Portola shall be provided by the property owner. 4. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 5. Size, number and location of driveways to public works specifications with only 2 driveway approaches to be allowed to serve this property. 6. Execute future improvement agreement for Portola Avenue prior to grading permit issuance. FIRE MARSHAL CONDITIONS 1. Existing fire protection requirements are in effect and remain adequate for this project. 2. Additional fire protection requirements may be necessary when the appli- cant submits specific plans for consideration and approval.
