A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF AN INDUSTRIAL/ADMINISTRATION
BUILDING ON THE WEST SIDE OF COOK STREET,
APPROXIMATELY 650 FEET NORTH OF 42ND STREET.
CASE NO. PP 84-45
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 20th day of November, 1984, hold a duly noticed public hearing to consider the request
of COACHELLA VALLEY TELEVISION for approval of a negative declaration of
environmental impact and a precise plan of design to allow construction of a 20,650
square foot industrial/administration building on 2.92 acres in the S.I./S.P. (service
industrial district with a scenic preservation overlay) zone located on the west side of
Cook Street, approximately 650 feet north of 42nd street, more particularly described as:
APN 624-040-006
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse impact on the environment and a negative declaration
of environmental impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 84-45 is hereby granted for reasons subject to
the attached conditions.
3. That a Negative Declaration of Environmental Impact has been approved.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 20th day of November, 1984, by the following vote, to
wit:

CONDITIONS OF APPROVAL
PP 84-45
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes in force, or which hereafter may be in
force.
3. Construction of a portion of said project shall commence within twelve months
from the date of final approval unless an extension of time is granted by the
planning commission; otherwise said approval shall become null, void and of no
effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
Riverside County Department of Health
City Fire Marshal
Evidence of said permit or clearance from the above agencies shall be presented to
the Department of Building and Safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Detailed exterior parking lot lighting plan in compliance with applicable standards ay1
to be submitted to the city prior to issuance of building permits, for approval;
lights to be down -shining box type to minimize glare.
6. The four foot high slump block wall facing Cook Street shall be set back five feet
further from the street to provide additional landscaping.
7. A minimum four foot high slump block wall shall be provided along north property
line between existing chainlink fence and wall along Cook Street.
8. Prior to issuance of a building permit, the applicant shall provide mitigation
measures in the form of fees of $750 per acre for the undeveloped area for a
Fringe -Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to
be placed in a fund to be used for acquisition of land for a lizard preserve in the
Coachella Valley.
9. That the applicant shall pay fees into the fire protection fund as established by city
ordinance for fire site apparatus and equipment acquisition.
10. All existing electrical distribution lines, telephone, cable antenna television, and
similar service wires or cables, which are on or adjacent to the property being
developed shall be installed underground, if practicable, as a part of development
from the nearest existing pole not on the property being developed.
Department of Public Works:
11. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to building permit issuance.
12. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the Director of Public Works.

13. Storm drain construction shall be contingent upon a drainage study by the private
engineer that is approved by the department of public works.
14. Full public improvements, including traffic safety lighting, as required by
ordinance and the director of public works, shall be installed in accordance with
city standards.
15. Improvement plans for water and sewer systems shall be approved by the
respective service districts with "as -built" plans submitted to the department of
public works prior to the project final.
16. Complete improvement plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval before construction of
any improvements is commenced. The engineer shall submit "as -built" plans prior
to the acceptance of the improvements by the city.
17. Landscaping maintenance on Cook/Eclectic shall be provided by the property
owner.
18. Existing utilities on Cook Street shall be undergrounded per each respective utility
district's recommendation.
19. Traffic safety striping on Cook Street shall be provided to the specifications of the
director of public works. A traffic control plan must be submitted to and approved
by the director of publi works before placing pavement markings.
20. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
21. Dedication of 11 feet of right-of-way on Cook Street shall be done prior to
issuance of any permits and approval of plans.
22. Installation of curb and gutter, matching paving and sidewalk on Cook Street.
23. Waiver of access to Cook Street except at approved locations shall be granted by
separate instrument.
24. Offsite improvement plans to be approved by public works department and a surety
posted to guarantee the required offsite improvements prior to issuance of the
building permit.
25. Installation of one-half landscaped median in Cook Street or cash payment for one-
half the cost of landscaped median at the option of the director of public works.
26. Size, number and location of driveways to public works specifications with only two
driveway approaches to be allowed to serve this property.
City Fire Marshal:
27. Install a water system capable of delivering 3500 GPM fire flow from any fire
hydrant for a 3 hour duration in addition to domestic supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement. Fire flow
requirements will depend on built-in fire protection provisions of buildings.
28. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
c. hydrants shall not be located closer than 25 feet to any building.

29. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the Fire Marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
30. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in PP 84-45 is in accordance with the requirements prescribed
by the Fire Marshal."
31. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
32. Any building over 12,000 square feet will require a monitored fire sprinkler system.
33. Fire lanes will be required.
34. Additional fire protection requirements may be necessary when the applicant
submits specific plans for consideration and approval.
