A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL APPROVAL
OF CONVERSION OF A DWELLING UNIT INTO FOUR
HOTEL UNITS AND A CHANGE OF ZONE FROM MULTI-
FAMILY RESIDENTIAL TO GENERAL COMMERCIAL
FOR PROPERTY LOCATED AT THE NORTHWEST
CORNER OF DEEP CANYON ROAD AND ABRONIA
TRAIL, AND A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT AS IT PERTAINS THERETO.
CASE NO. C/Z 84-17, CUP 84-11
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 18th day of December, 1984, hold a duly noticed public hearing to consider a request
by DEEP CANYON LTD for the above mentioned project.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
a negative declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts to justify their actions, as described below:
1. There are changed conditions from when original zoning was adopted.
2. The proposed change of zone will not be detrimental to the public health,
safety, or general welfare and be compatible with adjacent zoning.
3. The proposed change of zone is consistent with the goals and policies of the
city's adopted general plan.
4. The proposed location of the conditional use is in accord with the objectives
of the municipal code and the purpose of the district in which the site is
located.
5. The proposed location for the conditional use and the conditions under which
it would be operated or maintained will not be detrimental to the public
health, safety, or welfare, or be materially injurious to properties or
improvements in the vicinity.
6. The proposed conditional use will comply with each of the applicable
provisions of the municipal code except for approved variances or
adjustments.
7. The proposed conditional use complies with the goals, objectives and policies
of the city's general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the city council
approval of a change of zone from R-3 to C-1 and approval of CUP 84-11,
for reasons subject to in the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 18th day of December, 1984, by the following vote, to
wit:
AYES: DOWNS, ERWOOD, WOOD, AND CRITES

ABSENT: NONE

CONDITIONS OF APPROVAL
Case No. CUP 84-11
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions and subsequent revisions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by the approval, the applicant shall first complete all the procedural
requirements of the city which include, but are not limited to, architectural
review, building permit procedures, Riverside County Department of Health, and
Coachella Valley Water District.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinance and state and federal statutes now in force, or which hereafter may be in
force.
Department of Public Works:
4. Landscaping maintenance on Abronia Trail/Deep Canyon Drive shall be provided by
the property owner.
5. Installation of curb and gutter, matching paving and sidewalk on Abronia Trail and
Deep Canyon where applicable.
6. Size, number, and location of driveways to public works specifications with only
four driveway approaches to be allowed to serve this property.
