A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL APPROVAL
OF A GENERAL PLAN AMENDMENT, A
PREANNEXATION CHANGE OF ZONE, AND TENTATIVE
PARCEL MAP FOR 88.86 GROSS ACRES LOCATED AT
THE FUTURE NORTHEAST CORNER OF GERALD FORD
DRIVE AND MONTEREY AVENUE.
CASE NOS. GPA 84-3, C/Z 84-18, and PM 20560
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 15th day of January, 1985, hold a duly noticed public hearing to consider MONTEREY
AVENUE ASSOCIATES for approval of a general plan amendment from low density
residential (3-5 du/acre) to district commercial (for 20 net acres), a preannexation change
of zone form W-2-20 (Riverside County zoning) to PC (2) (district commercial) and PR-5
(planned residential, five dwelling units per acre), a parcel map to divide two existing lots
into four parcels, and a negative declaration of environmental impact as it relates to the
above for 88.9 acres located at the future northeast corner of Gerald Ford Drive and
Monterey Avenue, more particularly described as:
APN's 653-260-003 and 653-260-004
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse impact on the environment and a negative declaration
has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts and reasons to exist to justify approval of this request:
General Plan Amendment:
1. The location of the proposed commercial designation is adjacent to
commercial zoning to the south.
2. The proposed commercial designation would cluster commercial zoning
along the future Monterey Avenue.
3. The commercial designation will not be detrimental to the health, safety, or
general welfare of adjacent properties.
4. The location of the proposed commercial designation is on major
thoroughfares which will be able to accommodate any traffic generated.
Change of Zone:
1. Prezoning is necessary to complete annexation of the property.
2. The proposed PR-5 zoning is in conformance with the general plan land use
designation of low density residential (3-5 dwelling units per acre).
3. The proposed PC (2) zoning would be in conformance with the general plan
land use designation of district commercial with the approval of GPA 84-3.
4. The land uses and resulting density from the change of zone would be
compatible with planned adjacent land uses and not be detrimental to the
health, safety, or general welfare of adjacent properties.
Parcel Map:
1. That the proposed map is consistent with applicable general and specific
plans.
2. That the design or improvement of the proposed map is consistent with
applicable general and specific plans.
3. That the site is physically suitable for the type of development.

4. That the site is physically suitable for the proposed density of development.
5. That the design of the parcel map or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.
6. That the design of the subdivision or the type of improvements is not likely
to cause serious public health problems.
7. That the design of the subdivision or the type of improvements will not
conflict with easements, acquired by the public at large, for access through
or use of property within the proposed subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in these cases;
2. That the planning commission does hereby recommend to the city council
approval of a general plan amendment from low density residential (3-5 du
per acre) to district commercial per attached exhibit 'A.'
3. That the planning commission does hereby recommend to the city council
approval of a preannexation change of zone from W-2-20 (Riverside County)
to PC (2) and PR-5 per attached exhibit 'B.'
4. That the planning commission does hereby recommend to the city council
approval of a tentative parcel map, subject to the attached conditions.
5. That a Negative Declaration of Environmental Impact is hereby
recommended for approval.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 15th day of January, 1985, by the following vote, to
wit:

CONDITIONS OF APPROVAL
Case No. PM 20560
Department of Environmental Services:
1. Parcel Map 20560 is granted for the land as described in the attachments hereto,
and as shown on exhibits on file with the department of environmental services and
the requirements herein.
2. All requirements of any law, ordinance, or regulation of the state, city and any
other applicable government entity, shall be complied with as a part of this map.
3. Pursuant to municipal code requirements, tentative parcel map shall be recorded
within two years from date of approval, unless an extension of time is granted,
otherwise said approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit, the applicant shall provide mitigation
measures in the form of fees of $750 per acre for a Fringe -Toed Lizard (UMA
INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be
used for acquisition of land for a lizard preserve in the Coachella Valley. If fee is
lowered, excess fees shall be refunded to developer.
Department of Public Works:
1. Dedication of 55 feet of right-of-way on Monterey Avenue and 50 feet of right-of-
way on Gerald Ford Drive shall be done prior to recordation of final map.
2. Installation of one-half landscaped median in Monterey Avenue or cash payment for
one-half the cost of landscaped median at the option of the director of public
works.
3. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to recordation of the final map.
4. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the director of public works.
5. Storm drain construction shall be contingent upon a drainage study by the private
engineer that is approved by the department of public works.
6. Landscaping maintenance on Monterey and Gerald Ford shall be provided by the
property owner.
7. Full half -street public improvements, including traffic safety lighting, etc., shall
be installed in accordance with city standards.
