HomeMy WebLinkAboutRes No 1027PLANNING COMMISSION RESOLUTION NO. 1027 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A COMMERCIAL PARKING LOT IN AN R-3 ZONE. CASE NO. CUP 84-13 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of January, 1985, hold a duly noticed public hearing to consider the request of PROTECTION SERVICES INC. for approval of a conditional use permit to allow a commercial parking lot for a retail business in the R-3 (4) zone located on the north side of Alessandro Drive, approximately 140 feet west of Santa Anita Avenue, more particularly described as: Lot 9, Block F, Palma Village Unit 6 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a class 11 categorical exemption and no further documentation is necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 84-13 is hereby granted for reasons subject to the attached conditions. DIAZ, Secre /tm BUFORD CRITES, Chairman PLANNING COMMISSION RESOLUTION NO. 1027 CONDITIONS OF APPROVAL CUP 84-13 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to allow municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Parking lot lighting to be limited to low (maximum 3 feet high) lights. 6. Pursuant to municipal code requirements, an agreement be recorded guaranteeing that the proerty will voluntarily be a part of any power pole undergrounding district which is subsequently established by the city including the property in question. 7. Specific location of security gate to be approved by city during architectural review process. 8. Landscaping plan to be approved by architectural commission prior to issuance of any grading or building permits; owner to provide professional landscaping maintenance in perpetuity. 9. Northerly end of parking area to be striped and marked "no parking." 10. Solid side walls to be stepped down to 4 feet in height within 20 feet of front property line. 11. Applicant shall contact the Palm Desert Water and Services District regarding their comments noted in their letter dated December 10, 1984, on file in the department of environmental services. Department of Public Works: 12. All appropriate fees, as required by city ordinance, shall be paid prior to grading. 13. Landscaping maintenance on Alessandro Avenue shall be provided by the property owner. 14. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. Planning Commission 15.
