A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A CONDITIONAL USE PERMIT ALLOWING A SECOND
SENIOR UNIT WITHIN AN EXISTING SINGLE FAMILY
HOME LOCATED AT THE NORTHEAST CORNER OF
TAMPICO DRIVE AND FAIRHAVEN DRIVE.
CASE NO: CUP 85-1
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 4th day of June 1985, hold a duly noticed public hearing to consider a request
by SANTA FE DEVELOPMENT #1 for approval of a second senior unit under section
25.21 of the municipal code to be located within a single family home at the
northeast corner of Tampico Drive and Fairhaven Drive.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined
that the project is statutorily exempt.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments of all interested persons desiring to be heard, said commission did find the
following facts to exist to justify their actions:
1. The project as conditioned complies with all requirements of the zoning
ordinance and section 65852.2 of the California Government Code.
2. The proposed use will not be detrimental to the public peace, health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.
2. CUP 85-1 is hereby approved subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 4th day of June, 1985, by the following vote, to
wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 85-1
Department of Environmental Services:
1. The development of the second unit shall comply with provisions of chapter 25.21
of the zoning ordinance in addition to other applicable chapters.
2. Applicant shall provide the city with evidence on an annual basis showing that
the second unit is being occupied by residents over the age of 60. Failure to
comply with provisions may result in revocation of this approval.
3. Prior to occupancy, applicant shall submit landscape plan to the city for approval
showing upgraded plant materials and side yard fencing.
4. 1500 gallon septic tank shall be provided.
