A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A TENTATIVE TRACT MAP TO ALLOW THE
SUBDIVISION OF A 42 ACRE SITE LOCATED AT THE
NORTHEAST CORNER OF COOK STREET AND FRED
WARING DRIVE AND A NEGATIVE DECLARATION AS IT
RELATES THERETO.
CASE NO. TT 20817
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 21st day of May, 1985, hold a duly noticed public hearing to consider a request by
ROBERTSON HOMES for the above mentioned matter.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant impact on the environment and a negative
declaration of environmental impact is warranted.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Planning Commission did find
the following facts and reasons as justified in the staff report for dated on file in the
department of environmental services, to exist to approve the tentative tract map:
(a) That the proposed map is consistent with applicable general and specific
plans.
(b) That the design or improvement of the proposed subdivision is consistent
with applicable general and specific plans.
(c) That the site is physically suitable for the type of development.
(d) That the site is physically suitable for the proposed density of development.
(e) That the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of improvements is not likely
to cause serious public health problems.
(g) That the design of the subdivision or the type of improvements will not
conflict with easements, acquired by the public at large, for access through
or use of, property within the proposed subdivision.
WHEREAS, in the review of this tentative tract map the Planning Commission has
considered the effect of the contemplated action on the housing needs of the region for
purposes of balancing these needs against the public service needs of the residents of the
City of Palm Desert and its environs, with available fiscal and environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case;
2. That it does hereby approve the above described Tentative Map No. 20817
for the reasons set forth in this resolution and subject to the attached
conditions.
FURTHER, BE IT RESOLVED that the conditions of approval do include a
requirement that the applicant to comply with the requirements of Article 26.48 of the
City of Palm Desert Subdivision Ordinance. In return, the City agrees to use said for
park purposes in conformance with an adopted master plan, within five (5) years of the
recordation of the final map.
PASSED, APPROVED and ADOPTED at a regular, meeting of the Palm Desert
Planning Commission, held on this 2nd day of July, 1985, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. TT 20817
Department of Environmental Services:
1. This approval is contingent upon final adoption of the proposed Housing Element to
the Palm Desert General Plan, GPA 84-01, and execution of a development
agreement.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the procedural
requirements of the city which include, but are not limited to, design review and
execution of the associated development agreement.
3. The development of the property shall conform with all approved exhibits on file
with the department of environmental services and to all municipal, state and
federal statutes now in force or which hereafter may be in force.
4. Construction of a portion of said project shall commence within one year from the
date of final approval unless a time extension is granted, otherwise said approval
shall become null, void, and of no effect whatsoever.
5. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
6. Provisions for mail service shall be coordinated with the Palm Desert Branch U.S.
Postal Service.
7. Location and design of trash enclosures shall be coordinated with Palm Desert
Disposal Co.
8. Prior to issuance of building permits, developer must pay $628 per d.u. for school
impact fees.
9. Six foot wall or fence required along south, east, and west property lines.
10. Location of access road onto Fred Waring Drive to be between 600 and 650 feet
from centerline of Cook Street.
11. Tennis courts are to be set back 10 feet from property line and sunken four feet.
City Fire Marshal:
12. Install a water system capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement. Fire flow
requirements will depend on built-in fire protection provisions of buildings.
13. Install Riverside County super fire hydrants so that no point of any building is more
than 250 feet from a fire hydrant measured along approved vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
c. hydrants shall not be located closer than 25 feet to any building.

14. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
15. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the design
of the water system in TT 20817 is in accordance with the requirements prescribed
by the fire marshal."
16. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
17. Install emergency vehicle receiver on entrance gate.
18. Provide secondary emergency vehicle access.
19. All buildings over 5000 square feet may require a sprinkler system.
20. Additional fire protection requirements may be necessary when the applicant
submits specific plans for consideration and approval.
Department of Public Works:
21. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to recordation of the final map.
22. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the director of public works.
23. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
24. Full public improvements, including traffic study lighting as required by ordinance
and the director of public works, shall be installed in accordance with city
standards.
25. Improvement plans for water and sewer systems shall be approved by the
respective service districts.
26. Complete improvement plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval before construction of
any improvements is commenced. The subdivider shall submit "as -built" plans prior
to acceptance of the subdivision improvements by the city.
27. All private streets shall be inspected by the engineering department and a standard
inspection fee shall be paid.
28. Landscaping maintenance on Cook/Fred Waring shall be provided by the owner.
29. Existing utilities on Cook/Fred Waring shall be undergrounded.
30. Traffic safety striping on Cook/Fred Waring shall be provided to the specifications
of the director of public works. A traffic control plan must be submitted to and
approved by the director of public works before placing pavement markings.
31. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
32. Dedication of 11 feet of right-of-way on Cook/Fred Waring shall be done prior to
issuance of any permits and approval of plans.
33. Installation of curb and gutter at 43 feet from centerline on Cook/Fred Waring,
with matching paving and 8 foot meandering sidewalk on Cook Street only.

34. Waiver of access to Cook Street except at approved locations shall be granted prior
to permit issuance.
35. Offsite improvement plans to be approved by public works department and a surety
posted to guarantee the required offsite improvements prior to building permits
being issued.
36. Full improvement of interior streets based on residential street standards.
37. Installation of one-half landscaped median in Cook or cash payment for one-half
the cost of landscaped median at the option of the director of public works.
Developer shall bond for one-half landscaped median on Fred Waring.
38. Traffic analysis to be prepared for the project. If traffic signals are warranted,
the developer shall install them.
39. Size, number, and location of driveways to public works specifications.
40. Five foot setback required for walls on Cook Street and Fred Waring Drive.
41. Private streets in single family area to allow parking on both sides to equal 38 feet
in width.
42. Landscaping maintenance on Cook/Fred Waring be provided by owner of
maintenance district with the establishment of which paid for by the owner who
will also waive the right to protest.
Sheriff's Department:
43. Post at front entrance a detailed plot map showing complete layout of facilities,
including each address, recreation areas, pools, and clubhouses (if any).
