HomeMy WebLinkAboutRes No 1057PLANNING COMMISSION RESOLUTION NO. 1057 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A CONDITIONAL USE PERMIT ALLOWING AN ADDITION TO AN ATHLETIC CLUB LOCATED AT THE NORTHEAST CORNER OF ALESSANDRO DRIVE AND SAN CARLOS AVENUE. CASE NO. CUP 03-81 (Amendment #2) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of July, 1985, hold a duly noticed public hearing to consider the request of JACK O. WISE (WISE PALM DESERT ATHLETIC CLUB) for approval of an amendment to a conditional use permit to allow addition of an outdoor swimming pool and a tennis court to an existing athletic club in the R-3 (4) zone located at the northeast corner of Alessandro Drive and San Carlos Avenue, more particularly described as: 73-600 Alessandro Drive WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project has been previously assessed in connection with the original consideration of CUP 03-81 and no further documentation is deemed necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit Amendment: 1. The findings which were substantiated for the conditional use permit in May, 1981, still apply and can be utilized for this amendment. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 03-81 (Amendment #2) is hereby granted for reasons subject to the attached conditions and applicable conditions for Planning Commission Resolution Nos. 837 and 705. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of July, 1985, by the following vote, to wit: AYES: DOWNS, RICHARDS, WOOD, AND ERWOOD NOES: NONE ABSENT: CRITES ABSTAIN: NONE ICHARD ERWOOD, Vice Chairman ATTEST: RAMON 'A DIAZ, Secretary /tm PLANNING COMMISSION RESOLUTION NO. 1057 CONDITIONS OF APPROVAL CUP 03-81 (Amendment ##2) Department of Environmental Services: 1. All applicable conditions of Planning Commission Resolution Nos. 837 and 705 shall remain in affect. 2. Construction of said addition shall commence within one year from date of this approval, unless extended by the planning commission; otherwise, said approval shall become null, void and of no effect whatsoever. 3. Tennis court to be unlit and sunk four feet below grade with chain link fencing and posts to be green as obtained from factory. 4. Landscaping maintenance, especially near easterly property line to be done in perpetuity. 5. Satellite receiver shall be reviewed by architectural commission with screening and/or relocation to be done prior to or with issuance of any building permit. Department of Public Works: 1. Curb, gutter, sidewalk, and matching paving to be installed along De Anza Way where needed as required by department of public works. 2. Additional storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Landscaping maintenance on San Carlos Avenue/Alessandro shall be provided by the property owner. 4. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits.
