HomeMy WebLinkAboutRes No 1060PLANNING COMMISSION RESOLUTION NO. 1060 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR AN AMENDMENT TO THE APPROVED DEVELOPMENT PLAN AT THE PALM DESERT TOWN CENTER TO PERMIT AN EXPANSION TO THE PROPOSED ROBINSON'S DEPARTMENT STORE FROM 94,000 SQUARE FEET TO 135,000 SQUARE FEET RESULTING FROM THE ADDITION OF ONE LEVEL BELOW THE EXISTING LOWER MALL LEVEL. CASE N0. PP 85-17 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of July, 1985 hold a duly noticed public hearing to consider the request by PALM DESERT TOWN CENTER for approval of a precise plan of design and negative declaration of environmental impact to allow expansion of the proposed Robinson's Department Store from 94,000 square feet to 135,000 square feet resulting from the addition of one level below the existing lower mall level. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of the property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 85-17 is hereby granted for reasons subject to the attached conditions. 3. That a negative declaration of environmental impact is hereby certi- fied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission. held on this 16th day of July, 1985, by the following vote to wit: AYES: DOWNS, ERWOOD, RICHARDS, WOOD & CRITES NOES: NONE ABSENT: NONE ABSTAIN: NONE B 0'1 CRITES, Chairman RAMON A. DIAZ, Secre PLANNING COMMISSION RESOLUTION N0. 1060 CONDITIONS OF APPROVAL CASE N0. PP 85-17 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval. the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect what- soever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for constriction of any use contemplated by this approval. the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District 6. That the applicant obtain approval of Palm Desert Disposal for provision of trash service. 7. That prior to issuance of any certificate of occupancy for Robinson's the center shall: a) Design, have reviewed and approved by planning commission and in usable condition parking for an additional 330 cars, or; b) Final with the city clerk of the city a bond or irrevocable letter of credit in an amount to be determined to guarantee that the additional parking spaces will be provided within three (3) years of the issuance of the Robinson's certificate of occupancy or sooner if determined to be needed following a hearing before planning commission. 8. If the applicant chooses to utilize the provisions of condition 7b above, then the applicant shall institute and actively enforce an employee parking program to utilize the perimeter parking areas.
