HomeMy WebLinkAboutRes No 1062PLANNING COMMISSION RESOLUTION NO. 1062 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM PR-6 S.P. TO PC (3) S.P. FOR LAND BOUNDED BY HIGHWAY 111, EL PASEO, FRED WARING DRIVE AND THE PALM VALLEY STORM CHANNEL. CASE NO. C/Z 85-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of July, 1985, hold a duly noticed public hearing to consider a request by H.F. AHMANSON & CO. for a negative declaration of environmental impact and a change of zone from PR-6 (planned residential) maximum 6 du/acre to PC (3) S.P. (planned regional commercial with a scenic preservation overlay) for 15.26 acres on land bounded by the Palm Valley Storm Channel, El Paseo, Fred Waring Drive and Highway 111, more particulary described as: APN 640-110-007 & 640-140-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify their actions, as described below: 1. Requested change will bring zoning into conformance with the General Plan and will allow development consistent with that of majority of abutting developed property. 2. This request is consistent with suggestions regarding this procedure made during recent zoning hearings. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That the planning commission does hereby recommend to the city council approval of a change of zone from PR-6, S.P. (planned residential, maximum 6 dwelling units per acre, scenic preservation overlay) to PC (3) S.P. (regional commercial, scenic preservation overlay) per attached Exhibit "A". 3. That a negative declaration of environmental impact is hereby recommended. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 16th day of July, 1985 by the following vote, to wit: AYES: DOWNS, RICHARDS, ERWOOD, WOOD & CRITES NOES: NONE ABSENT: NONE ABSTAIN: NONE BUFORD CRITES, Chairman ATTE RAMON A.
