HomeMy WebLinkAboutRes No 1076PLANNING COMMISSION RESOLUTION NO. 1076 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A VARIANCE TO ALLOW CONSTRUCTION OF GARAGES AND CARPORTS IN AN EXISTING RESIDENTIAL COMPLEX ON LAND BOUNDED BY PANORAMA DRIVE, SUNSET LANE, ABRONIA TRAIL, AND EL CAMINO. CASE NO. VAR 85-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of August, 1985, hold a duly noticed public hearing to consider the request of OTRA 1 for approval of a variance of the front and side yard setbacks to allow construction of garages and carports over existing parking spaces in the R-3 (multiple -family residential district) zone located on land bounded by Panorama Drive, Sunset Lane, Abronia Trail and El Camino, more particularly described as: 45-210, 45-242, 45-270, 45-296, 45-320 Panorama Drive 45-225, 45-275, 45-303, 45-313 Sunset Lane WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implement of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 3 categorical exemption and no further documentation is deemed necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said variance: 1. There are practical difficulties or unnecessary physical hardships inconsistent with the objectives of this ordinance that would result if the variance is not granted. 2. There are exceptional or extraordinary circumstances or conditions that apply to the property that do not apply generally to other properties in the same zone. 3. The strict or literal interpretation and enforcement of the specified regulation will deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. 4. The granting of this variance would not be detrimental to the public health, safety, and welfare of properties and improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: PLANNING COMMISSION RESOLUTION NO. 1076 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That approval of VAR 85-2 is hereby granted for reasons subject to the attached conditions. DIAZ, Ser_retafy/' /tm 2 F RD CRITES, Chairman PLANNING COMMISSION RESOLUTION NO. 1076 CONDITIONS OF APPROVAL Case No. VAR 85-2 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void, and of no effect whatsoever. 4. Structures at corners shall be one garage and two carport type rovers, with carports to be two spaces closest to street where access is taken. 5. Short wall (3 feet high) or row of shrubs shall be provided adjacent to carport type spaces next to streets. 6. Existing trees to be retained if possible. Department of Public Works: 7. All encroachment into the public right-of-way shall be approved and inspected by the engineering department and a standard inspection fee and encroachment permit fee shall he paid prior to any permit issuance. 8. Traffic analysis to be prepared for the project to address the specific impacts on visibility and the proposed mitigation measures recommended for approval by the city. 9. All garages and carport roofs shall he sloped towards the driveways to allow for drainage onto the driveways and into street gutters. 3
