A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF AN AMENDMENT TO
CHAPTER 25.100 OF THE CITY OF PALM DESERT ZONING
ORDINANCE TO PERMIT TIMESHARE DEVELOPMENTS IN
THE PR ZONE AND ESTABLISHING STANDARDS OF
DEVELOPMENT THEREFORE.
CASE NO. ZOA 85-6
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the ist day of October, 1985, hold a duly noticed public hearing to
consider a proposed amendment to the Palm Desert Municipal Code to permit
timeshare development in the PR (planned residential zones); and
WHEREAS, after taking testimony from all wishing to address the commission
of said proposal along with a staff report; and
WHEREAS, the commission has concluded that timeshare development could
occur in the PR zone and not be injurious to health, safety, and public
welfare, subject to the following limitations:
1. A conditional use permit and the required findings to grant approval,
therefore;
2. Such developments must meet all requirements of the PR zone including
but not limited to density, unit size, parking, ground coverage,
open space;
3. All units in such projects must be entirely timeshare;
4. Such projects must be fee ownership;
5. Maintenance agreements and CC&R's must be approved by the city.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That the planning commission does hereby recommend to the city
council approval of a Zoning Ordinance Amendment 85-6 as provided in
the attached exhibit labeled Exhibit "A."

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 1st day of October, 1985, by the following
vote, to wit:

EXHIBIT "A"
Section 25.100.20 amended to read:
A time-share project shall be permitted only in the planned commercial resort
(PC-4) zone, when developed in conjunction with a hotel or general commercial
(C-1) zone, or planned residential (PR) zone, and then only if and when a
conditional use permit has been obtained therefore from the planning commission
in accordance with chapter 25.72 of this code.
Section 25.100.035 is added:
Section 25.100.035. Timeshare in planned residential zones.
Notwithstanding any other provisions of this chapter the following conditions
must be met by any timeshare development in the planned residential zone.
1. The density of the project shall not exceed the density permitted in the
zone for residential projects.
2. The timeshare development must comply with all development standards for
residential projects in the PR zone.
3. The entire development (all units within the project) must be timeshare
units.
4. The project must be a "fee ownership" time share.
5. All maintenance agreements and CC&R's must be approved by the City of
Palm Desert.
6. The minimum time share unit shall be for one week (7 days).
Section 25.45.035 is added:
Section 25.24.035. Uses permitted by approved conditional use permit.
A. Time-share projects as setforth in chapter 25.100.
