A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, DENYING A
CHANGE OF ZONE FORM PR-5 TO AHDPR-18.
CASE N0. C/Z 85-10
WHEREAS. the Planning Commission of the City of Palm Desert, California,
did on the 5th day of November, 1985 hold a duly noticed public hearing to
consider the request of JOHN M. TURNER for approval of a change of zone from
PR-5 (planned residential 5 units per acre) to AHDPR-18 (affordable high
density planned residential 18 units per acre) for a 4.25 acre site located on
the north side of Magnesia Falls Drive 676 feet east of Portola Avenue, more
particularly described as:
APN 624-120-004, 006
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of community development has
determined that the project would not have a significant impact on the
environment and a negative declaration has been prepared.
WHEREAS, at said public hearing,k upon hearing and considering all
testimony and arguments, of all interested persons desiring to be heard, said
commission did find the following facts to justify its actions, as described
below:
1. The housing element established a goal of 1200 low and moderate
housing units to be achieved within a 5 year period. In the first
year more than 84% has been attained. This 84% figure does not
include density bonus project (ie: 352 units at Mountain View Falls
among others).
2. Six potential high density areas were delineated in the housing
element, however, there was no guarantee that all six would be
developed under the program. If all six were to develop the city
would achieve considerably in excess of the identified need of 1200
units. The identified 1200 unit need was over a 5 year period.
3. The impacts of the already approved and developed high density units
in the city have not been adequately assessed.
4. Approval of additional affordable high density projects at this
time is premature.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That the planning commission does hereby deny change of zone 85-10.
3. That a negative declaration of environmental impact is hereby
certified.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of November, 1985, by the following
vote, to wit:

NOES: RICHARDS
ABSENT: NONE
ABSTAIN: NONE
