A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT. CALIFORNIA, APPROVING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT.
CONDITIONAL USE PERMIT AND PRECISE PLAN TO ALLOW
USE OF AN EXISTING FOUR UNIT APARTMENT COMPLEX
AS MEETING ROOMS, OFFICES, PRIEST RESIDENCES AND
OFF-STREET PARKING LOCATED ON FOUR LOTS AT THE
SOUTHWEST CORNER OF FRED WARING DRIVE AND SAN
PABLO DRIVE.

WHEREAS. the Planning Commission of the City of Palm Desert. California.
did on the 15th day of October and continued hearing on November 19, 1985 hold
a duly noticed public hearing to consider the request by NEWMAN CENTER for
approval of a negative declaration of environmental impact. conditional use
permit and precise plan to allow use of an existing four unit apartment complex
as meeting rooms, offices. priest residences and off-street parking located on
four lots at the southwest corner of Fred Waring Drive and San Pablo Drive.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of environmental services has
determined that the pro.iect will not have an adverse impact on the environment
and a negative declaration has been prepared.
WHEREAS, at said public hearing. upon hearing and considering all
testimony and arguments, of all interested persons desiring to be heard, said
commission did find the following facts and reasons to exist to justify their
actions:
1. The proposed use of the property is compatible with the surrounding
uses and will not be detrimental to the public health. safety or
welfare.
2. The proposed use is consistent with goals and objectives of the Palm
Desert General Plan, Zoning Ordinance and Palma Village Specific
Plan.
NOW. THEREFORE. BE IT RESOLVED by the Planning Commission of the City of
Palm Desert. California. as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That CUP 85-5, PP 85-32 and negative declaration of environmental
impact are hereby approved subject to attached conditions.
PASSED. APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission. held on this l9th day of November. 1985. by the following
vote to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 85-5/PP85-32
Department of Community Development/Planning:
1. Prior to the issuance of a building permit for construction of anv uses
contemplated by this approval, the applicant shall first complete all the
procedural requirements of the city which include. but are not limited
to. architectural review and building permits.
2. The development of the property shall conform with all approved exhibits
on file with the department of community development. to all municipal.
state. and federal statutes now in force or which hereafter may be in
force.
3. Prior to issuance of a building permit for construction of any use
contemplated by this approval. the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Water and Services District
4. Location and desian of trash enclosures shall be coordinated with Palm
Desert Disposal Company.
5. Prior to the issuance of anv building or grading permits. applicant shall
submit and gain approval of a parcel map or parcel map waiver consoli-
dating all parcels involved in the proposed construction.
Department of Public Works:
1. Drainage and sianalization fund fees, as required by city ordinance.
shall be paid prior to building permit issuance.
2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
3. Full public improvements, including traffic safety lighting. as required
by ordinance and the director of public works. shall be installed in
accordance with city standards.
4. Complete improvement plans and specifications shall be submitted, as
required by ordinance to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall
submit "as -built" plans prior to acceptance of the improvements by the
city.
5. All private driveways and parking lots shall be inspected by the engine-
ering department and a standard inspection fee shall be paid prior to any
permit issuance.
6. Landscaping maintenance on Fred Waring Drive and San Pablo Avenue shall be
provided by the property owner.
7. Complete grading plans and specifications shall be submitted. as required
by ordinance. to the city engineer for checking and approval prior to
issuance of any permits.
8. Dedication of sufficient right-of-way for minimum six foot sidewalks on
San Pablo Avenue and Fred Waring Drive shall be done prior to issuance of
anv permits and approval of plans.
9.
Installation of sidewalk on San Pablo and Fred Waring.
10. Close unused driveway with full height curb and gutter.
11. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
permit issuance.
12. Size. number and location of driveways to public works specifications
with only 2 driveway approaches to be allowed to serve this property.
13. Any permit issuance shall be subiect to the waiver of parcel map first
being approved and recorded.
City Fire Marshal:
1. Existing fire protection requirements are in effect and remain adequate
for this proiect.
2. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
