CALIFORNIA. APPROVING A PRECISE PLAN OF DESIGN AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION OF 3 APARTMENT UNITS LOCATED AT THE SOUTHWEST CORNER OF SAN GORGONIO AND L.AS PALMAS. CASE NO. PP 85-42 WHEREAS, the Planning Commission of the City of Palm Desert, California, on the 7th day of January, 1986 hold a duly notice public hearing to the request by JAMES FETRIDGE for a precise plan of design and declaration of environmental impact to allow construction of 3 units on an 8170 square foot lot in the R-3 zone located at the corner of San Gorgonio and Las Palmas, more particularly described APN 627-092-014 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89" in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested person desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design. 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of the property in the vicinity by the occunants thereof - for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert. California. as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 85-42 is hereby granted for reasons subiect to the attached conditions. 3 That a negative declaration of environmental impact is hereby certified. PP 85-42 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development. as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include. but are not limited to, architectural review and buildinn permit procedures. . Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted. other- wise said approval shall become null, void and of no effect whatsoever. 4. (-he development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may he in force. 5. Prior to issuance of a building permit for construction of any use contem- plated by this approval. the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Property Owner's Association Evidence of said permit or clearance from the above agencies shall he presented to the department of building and safety at this time of issuance of a building permit for the use contemplated herewith. 6. That prior to issuance of building permit the owner (developer) provide the City with evidence that he has paid the required school mitigation fee ($628/unit) to the Desert Sands Unified School District. 7. That the applicant obtain approval of Palm Desert Disposal for provision of trash service. 8. That a six (6) foot high wall be provided along the west property line. 3 PLANNING COMMISSION RESOLUTION NO. 1108 That the applicant consolidate the property with the lot to the south or that an agreement guaranteeing in perpetuity access to the swimming pool for all units, be executed and recorded. Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall he paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting and street reconstruction, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to any permit issuance. 6. Landscaping maintenance on Las Palmas Avenue and San Gorgonio Way shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of curb and gutter, matching paving and sidewalk on San Gorgonio Way and sidewalk on Las Palmas Avenue. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to service this property. 11. Utility at northwest corner of property shall be undergrounded as per Southern California Edison's recommendation. 12. Asphalt curb on San Gorgonio Way must be removed and replaced with concrete curb and gutter as per city standards no 102. 4 PLANNING COMMISSION RESOLUTION NO. 1108 City Fire Marshal: I. Prior to issuance of a building permit, the developer shall furniH,h the original and three conies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan sha 1 I be signed by a registered civil engineer .:Ind approved by the water company with the following certification: "i certify that the design of the water system in PP 85--42 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site. the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection reouirements may he necessary when the aonlicant submits specific plans for consideration and approv,)l.
