A RESOLUTION OF THE Pt ANN 1 NG COMMISSION OF THE
CITY OF PAl M DESERT, CALIFORNIA, APPROVING A
PRECISE PLAN OF DESIGN, PARCEL MAP AND NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT FOR PROPERTY
tOCATED ON THE EASTERLY SIDE OF HIGHWAY Ii1.
BETWEEN PARK ViEW DRIVE AND FRED WARING DRIVE.
CASE NOS. PP 85-46 AND PM 21412
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 4th day of March, 1986, hold a duly noticed public hearing to
consider the request of D 8 D DEVELOPMENT CO/DSL SERVICE CORPORATION, for
approval of a negative declaration of environmental impact and precise plan of
design and parcel map to consolidate parcels to create three new parcels on 19
net acres to allow construction of a 228 room hotel with a restaurant on 11.7
acres, for property zoned PC (4) S.P. located on the easterly side of Highway
Ill, between Park View Drive and Fred Waring Drive, more particularly described
as:

WHEREAS. said application has complied with the requirements of the "(City
of Palm Desert Procedure for implementation of the California Environmental
Quality Act, Resolution No. 80-Ag, " in that the director of community
development has determined that the project will not have an adverse impact en
the environment and a negative declaration of environmental impact has been
prepared; and
WHEREAS, at said public hearing, upon hearing and considering ail
testimony and arguments, if any, of all interested persons desiring to he
heard, said planning commission did find the following facts and reasons to
exist to justify granting approval of said precise plan:
1 The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the v i r i n i ty by the occupr,nts thereof for
lawful purposes.
The precise plan will not endanger the public peace, health, safety
or general welfare.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, it any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify granting approval of said parcel map:
1 That the proposed map is consistent with applicable general and
specific plans.

2, That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
3. That the site is physically suitable for the type of development.
4. That the site is physically suitable for the proposed density of
development.
5. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
6. That the design of the parcel map or the type of improvements is not
likely to cause serious public health problems.
7. That the design of the parcel map or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of property within the proposed parcel map.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That approval of Precise Plan 85-46 is hereby granted for reasons
subject to the attached exhibit 'A.'
3. That approval of Parcel Map 21412 is hereby granted for reasons
subject to the attached exhibit 'B.'
4. That a negative declaration of environmental impact is hereby
approved.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 4th day of March, 1986, by the following
vote, to wit:

EXHIBIT A'
CONDITIONS OF APPROVAL
CASE NO. PP 85-46
Department of Community Development:
the development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all municipal code requirements
to the degree that the city could consider each phase as a single project.
3. Construction of a portion of said project shall commence within 24 months
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, void, and of no effect
whatsoever.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may he in force.
5. Prior to issuance of a building permit for construction of anv use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Palm Desert Architectural Commission
Coachella Valley Water District
Riverside County Department of Health
City Fire Marshal
Evidence of said permit or clearance from the above agencies _hall he
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
6. Ali existing electrical distribution lines, telephone, cable antenna
television. and similar service wires or cables, which are adjacent to
the property being developed shall be installed underground, if
practicable, as a part of the development from the nearest existing pole
not on the property being developed.
7. Parking lot lighting system shall be designed to comply with municipal
code requirements with light standards to he maximum 20 feet high.
Lights to he down -shining box type light and provided with the shields
facing residential properties as required by city. Plans, specification.,

computer lighting print-out to he approved by city during architectural
review process.
8. Hammerheads or other approved turn-arounds shall be provided at the
westerly termination of Cactus Drive to the satisfaction of the city.
9. All parking areas adjacent to streets shall he screened by a three foot
six inch decorative wall, unless grading, landscaping or existing
improvements provide desired screening of parking lot surface.
10. Location of driveway(s) on Park View Drive shall be reviewed for traffic
safety and relocated and/or deleted as necessary to satisfaction of city.
11. Entire driveway on Highway 111 shall be constructed with this project.
12. Any combining of lots or modification of lot lines shall be completed
prior to issuance of any permits.
13. Any street vacations, if deemed necessary, shall be completed prior to
issuance of any permits.
14. Eight foot wide sidewalks on Highway 111 and Park View Drive to be
meandering with 10 foot wide easement on site for meandering to be
provided and recorded on Parcel Map 21412.
15. City entry monument to be constructed and maintained by applicant at
intersection of Park View Drive and Highway 111; design to be approved by
city prior to issuance of building permit with monument constructed with
hotel.
16. Bell tower area shall not exceed 35 feet in height, unless approved by
city council.
17. 1.04 acre parcel shown on Parcel Map 21412 shall be recorded as a part of
this project site. This area shall be held for a period of two years
after the hotel opening for use as an employee parking lot if deemed
necessary by planning commission during that two year period to relieve
deficient parking facilities.
18. All conditions of Caltrans shall be met.
19. Reciprocal vehicular easements shall he recorded to the satisfaction of
the city attorney between subject and adjacent parcels prior to issuance
of any permits; should city require cross access applicant shall provide
physical improvements on this site for connection.
20. As environmental mitigation measure, applicant shall install a five
phase, traffic actuated signal at Park View Drive and Highway 111 and
shall be operational by opening of hotel.

21. in all areas where proposed driveways are deleted, parking spaces shall
be provided.
22. Applicant shall obtain Coachella Valley Water District clearance regarding
conflicts with existing distrirt facilities prior to issuance of any
permits.
?"i. Applicant shall consider and implement crime prevention measures
stipulated in memorandum dated January 2, 198F.
?4. Parcel Map 21412 shall be recorded prior to issuance of building permit.
25. All exterior building lights shall he approved by the city prior to
issuance of building permit to insure that no detrimental Lighting i
installed.
26. All rooms shall have a minimum 375 sq. ft. of inside clear area.
27. The applicant shall contribute $50,000 for the purpose of widening Park
View Bridge crossing the Palm Valley Channel.
Department of Public Works:
I. Drainage and signalization fund fees. as required by city ordinance,
shall he paid prior to recordation of the final map.
Drainage facilities shall be provided, per Ordinance No. 218 and the
Master Drainage Plan, to the specifications of the director of pihlic
works.
3. Storm drain construction shall he contingent upon a drainage study by the
private engineer that is approved by the department of pi.ublic works.
4. Full public improvements, including traffic safety lighting as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
5. Complete improvement plans and specifications shall be submitted, as
required by ordinance. to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall
submit "as -built" plans prior to the acceptance of the improvements by
the city.
S. All private streets and driveway/parking areas shall he inspected by the
engineering department and a standard inspection fee shall he paid prior
to recordation of the final map.

%. Landscaping maintenance on Park View Drive/Highway 111/Fred Waring Drive
parking adjacent to site shall he provided by the property owner.
8. Existing utilities on Highway III and Fred Waring Drive shall he
undergrounded per each respective utility district's recommendation.
9. Traffic safety striping on Park View Drive/Highway III/Fred Waring Drive
shall he provided to the specifications of the director of public works.
A traffic control plan must be submitted to and approved by the director
of public works before placing pavement markings.
10. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
issuance of any permits.
11. Dedication of 55 feet/44 feet of right-of-way on Highway 111/Fred
Waring/Park View shall be done prior to issuance of any permits and
approval of plans.
12. Installation of curb and gutter, matching paving and sidewalk on Highway
Ill/Fred Waring Drive/Park View Drive.
13. Waiver of access to Highway 111/Fred Waring/Park View Drive, except at
approved locations, shall he granted on the final map.
14. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
recordation of the final map.
15. Installation of one-half landscaped median in Highway 111 (if access to
Highway 111 is allowed)/Fred Waring Drive or cash payment for one-half
cost of landscaped median at the option of the director of public works.
16. Traffic analysis to he prepared for the project to address the specific
impacts on existing networks (streets and intersections) and the proposed
mitigation measures recommended for approval by the city.
17. Complete parcel map shall be submitted, as required by ordinance, to the
city engineer for checking and approval and he recorded before issuance
of any permits.
18. Access to State Highway I11, if allowed, shall be limited to a single
right turn ingress right turn egress driveway no closer than 670 feet to
Park View Drive and no closer than 400 feet to Fred Waring Drive.
19. All improvements relating to State Highway 111 shall be per state
standards and specifications.

20 . Buis turnout sha l l be provided at Park View Drive and Highway 1 1 1 to the
satisfaction of the City of Palm Desert, California department of
Transportation and Sunlinc Transit Agency.
Fire Marshal:
1. install a water system capable of delivering 4000 (;PM fire flow from any
fire hydrant for a three hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of measurement. Fire flow requirements will depend on built-in fire
protection provisions of buildings.
2. Install Riverside County super fire hydrants so that no point of any
huilding is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surfaces of hydrant barrels and heads shall he painted
chrome yellow, and the tops and nozzle caps shall he painted green.
h. curbs shall be painted red 15 feet in either direction from earn
hydrant.
c. hydrants shall not he located closer than 25 feet to any huilding.
Prior to issuance of a building permit, the developer shall furnish the
original and two copies of the water system plan to the fire marshal for
review. Upon approval, one ropy will be sent to the huilding department,
and the original will be returned to the developer.
4. The water system plan shall he signed by a registered civil engineer and
approved by the water company, with the following certification: "1
certify that the design of the water system in Case Nos. PP 85-46/PM 21412
is in accordance with the requirements prescribed by the fire marshal."
5. Prior to delivery of combustible materials to the huilding site, the
required water system shall be installed. operating, and delivering the
required flow.
6. All buildings 5000 square feet require an approved fire sprinkler system.
7. All buildings 3 stories in height shall have a fire department standpipe
system installed on all floors.
8. All fire department sprinkler connections to be within 40 feet of a fire
hydrant and location approved by fire marshal.
9. Hotel will require a State Fire Marshal approved fire alarm system.

10. Porte-cochere height: 13' 6" minimum.
I1. All driveway turns are to have a 40 foot turning radius.
12. All kitchen hood and duct fire suppression systems, sprinkler. standpipe,
and fire alarm plans are to he approved by the fire marshal.
13. Install a fire department standpipe, off of public buildings sprinkler
system, in area of terrace.
14. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.

EXHIBIT B'
CONDITIONS OF APPROVAL
CASE NO. PM 21412
Department of Environmental Services:
1. Parcel Map 20894 is granted for the land as described in the attachments
hereto, and as shown on exhibits on file with the department of
environmental services and the requirements herein.
2. Ali requirements of any law, ordinance, or regulation of the state, city
and any other applicable government entity, shall be complied with as a
part of this map.
3. Pursuant to municipal code requirements, tentative parcel map shall he
recorded within two years from date of approval, unless an extension of
time is granted, otherwise said approval shall become null, void, and of
no effect whatsoever.
4. All conditions of CALTRANS shall he met.
5. 1.04 acre parcel shall he recorded as a part of 11.71 acre parcel.
6. Reciprocal vehicular easements shall he recorded to the satisfaction of
the city attorney between subject and adjacent parcels.
7. Along Park View Drive, Highway Ill and Fred Waring Drive, 10 foot wide
easement for meandering of public sidewalk shall be recorded on final map.
Department of Public Works:
I. Drainage and signalization fend fees, as required by city ordinance,
shall he paid prior to recordation of the final map.
