HENRY FOR A CONDITIONAL USE PERMIT TO ALLOW A PRESCHOOL, KINDERGARTEN AND DAY CARE CENTER FOR A MAXIMUM OF 80 CHILDREN IN AN EXISTING RESIDENTIAL PROJECT AT 44-215 SAN PASCUAL AVENUE. CASE N0. CUP 86-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of July 1986, hold a duly noticed public hearing to consider the request by ROBERT L. HENRY for approval of a conditional use permit to allow a preschool, kindergarten and day care center for a maximum of 80 children at an existing residential protect at 44-215 San Pascual Avenue, more particularly described as: APN 627-102-017 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a class 1 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detri- mental to the public health, safety or general welfare or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variance or adjustments. 4. The proposed conditional use complies with the goals, objectives and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. PLANNING COMMISSION RESOLUTION NO. 1154 2. That approval of CUP 86-2 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of July, 1986, by the following vote to wit: AYES: DOWNS, ERWOOD, RICHARDS, WOOD & CRITES NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: RAMON A. DIAZ, Secre /dig 2 IBUFORD CRITES, Chairman PLANNING COMMISSION RESOLUTION NO. 1154 CONDITIONS OF APPROVAL CASE NO. CUP 86-2 Department of Community Development: 1. Prior to issuance of business license for operation of this facility the applicant shall first obtain permits and/or clearances from the following agencies: Riverside County Department of Health City Fire Marshal Palm Desert Water and Services District 2. Total enrollment for facility shall not exceed 80 students. Department of Public Works: 1. Landscaping maintenance on San Pascual shall be provided by the property owner. City Fire Marshal: 1. Upon determination of occupancy classification, the applicant will be required to meet existing fire code standards, le, Title 19, Uniform Fire Code and local fire code ordinance. Applicant shall meet with fire marshal and obtain a list of specific requirements. Palm Desert Water & Services District: 1. That the comments provided in the letter from Palm Desert Water and Services District dated June 11, 1986 shall be met. /dig
