HomeMy WebLinkAboutRes No 1155PLANNING COMMISSION RESOLUTION NO. 1155 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF A 239 UNIT SENIOR CITIZEN HOUSING PROJECT ON 10.36 ACRES LOCATED ON THE EAST SIDE OF MONTEREY AVENUE 600 FEET NORTH OF SAN GORGONIO WAY. CASE ND: PP 85-5 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of July, 1986 hold a duly noticed public hearing to consider a request by CHARTER COMMUNITIES INC. for approval of an amended precise plan of design to allow construction of a 239 unit senior citizen housing project on 10.36 acres located on the east side of Monterey Avenue, 600 feet east of San Gorgonio Way. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community develop- ment has determined that the project has been previously assessed and a negative declaration approved. WHEREAS, at said public hearing upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to exist to justify the approval of said precise plan of design, as amended. 1. The amended precise plan is consistent with the goals and objectives of the general plan, Palma Village Specific Plan and the Senior Overlay standards. 2. The amended plan represents a lower intensity of development than originally approved. 3. The land use, site plan and architecture are compatible with the surrounding residential areas. 4. The project will not depreciate values, restrict the lawful use of adjacent properties nor will it threaten public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 85-5 as amended, is hereby granted for reasons subject to the attached conditions. DIAZ, Sec e /dig 2 BANNING COMMISSION RESOLUTION N0. 1155 CONDITIONS OF APPROVAL CASE N0. PP 85-5 Department of Community Development: 1. This approval shall be contingent upon execution of a development agree- ment implementing requirement of the senior overlay. 2. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null, void and of no effect whatsoever. 5. Prior to issuance of a building permit for construction of any use contem- plated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permits. 7. The minimum age for project occupant shall be age 62. 8. Access to the property shall be limited to the two points on Monterey. 9. The northerly access shall be modified so that only right turns are possible. 10. The applicant shall pay $628/unit school mitigation fee or as arranged by the Desert Sand Unified School District. PLANNING COMMISSION RESOLUTION NO. 1155 11. Hours of trash collection be maintained between 8:00 a.m. and 4:00 p.m. 12. Lot line adjustment on Mr. Kiger Barton's property be obtained with a minimum six foot adjustment. 13. Developer and neighborhood reach an agreement regarding the Guadalupe easement. 14. Developer increase the density of landscaping along the lot lines to further restrict any invasion of privacy that may be caused by the presence of second story balconies. 15. Applicant shall present to staff a market study on the air conditioning units. Department of Public Marks: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 5. Improvement plans for water and sewer systems shall be approved byu the respective service districts with "as -built" plans submitted to the department of public works prior to the project final. 6. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to the acceptance of the improvements by the city. 7. Landscaping maintenance on San Anselmo and Monterey Avenue shall be provided by the property owner. 8. Complete grading plans and specifications shall be submitted, es required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 4 PLANNING COMMISSION RESOLUTION N0. 1155 9. Installation of curb and gutter, matching paving and sidewalk on San Anselmo. 10. Waiver of access to Monterey Avenue except at approved locations shall be granted on the final map or plat. 11. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to recordation of the final map or permit issuance. 12. Traffic analysis to be prepared for the project to address the specific Impacts on existing networks (streets and intersections) and the proposed mitigation measures recommended for approval by the city. 13. Size, number and location of driveways to public works specifications with only three driveway approaches to be allowed to serve this property. 14. Completion of reversion to acreage process prior to issuance of any permits or approval of a parcel map prior to issuance of any permits. City Fire Marshal: 1. Install a water system capable of delivering 5000 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure In the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 5 RANTING COMMISSION RESOLUTION NO. 1155 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-5 is In accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Install an approved fire alarm systems. 7. Effective April 30, 1985 all buildings over 5000 square feet will require an approved fire sprinkler system. 8. Covered entry must be 13'6" high minimum. 9. All turns must have a 50 foot outside radius. 10. Additional fire protection requirements may be necessary when the appli- cant submits specific plans for consideration and approval. /dig 6
