A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, DENYING A
CONDITIONAL USE PERMIT AND MINIMUM UNIT SIZE
VARIANCE TO ALLOW CONVERSION OF FOUR EXISTING
RENTAL UNITS TO EIGHT SENIOR CITIZEN RENTAL
UNITS.
CASE N0. CUP 86-5 & VAR 86-4
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 5th day of August 1986 hold a duly noticed public hearing to
consider the request by RICHARD & MAY LEE for approval of a conditional use
permit and variance to allow conversion of four rental units to eight senior
citizen rental units under provisions of Chapter 25.52 of the Municipal Code,
located at the southeast corner of San Rafael Avenue and Catalina Way.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, of all interested persons desiring to be heard, said
commission did find the following facts and reasons to exist to justify the
denial of the request.
1. There are no practical difficulties or unnecessary physical hardship
associated with compliance other than those normally associated with
remodeling. To state that the required work is expensive is not
sufficient.
2. There are not exceptional circumstances which apply to the property
which do not apply to other senior overlay or R-2 zoned properties
in the vicinity. The proposed property does not contain any unusual
feature to differentiate it from surrounding properties.
3. Enforcement of the senior overlay standards will not be depriving
the applicant of privileges enjoyed by other owners of senior
overlay property in the vicinity. Three senior projects recently
approved in the area have been required to comply with the intensity
and unit size requirements from which a variance is being requested.
4. Without approval of a variance the application will not be consistent
with the senior overlay standards.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That CUP 86-5 and VAR 86-4 are hereby denied.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of August, 1986, by the following
vote, to wit:
