A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND
CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF
A 2000 SQUARE FOOT MINI MARKET AND TWO ISLAND
GAS STATION TO BE LOCATED AT THE SOUTHWEST
CORNER OF HIGHWAY 111 AND PORTOLA AVENUE.
CASE N0: CUP 86-1
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 19th day of August and the 7th day of October, 1986, hold duly
noticed public hearings to consider the request of ATLANTIC RICHFIELD COMPANY
for approval of a negative declaration of environmental impact and conditional
use permit to allow construction of a 2000 square foot mini market and gas
station at the southwest corner of Portola Avenue and Highway 111.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89", in that the director of community develop-
ment has determined that the project will not have an adverse impact on the
environment and a negative declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exit to justify their actions:
1. The proposed use and location is consistent with the goals of the
general commercial zone and general plan.
2. The proposed use and location will not be detrimental to the public
health, safety and welfare nor will it be materially injurious to
properties or improvements in the vicinity.
3. The proposed project will result in substantial improvement over
existing conditions.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That approval of Conditional Use Permit 86-1 is hereby granted for
reasons subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of October, 1986 by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE N0: CUP 86-1
Department of Community Development:
1. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the
procedural requirements of the city which include, but are not limited
to, architectural review and building permits.
2. The development of the property shall conform with all approved exhibits
on file with the department of community development, to all municipal,
state, and federal statutes now in force or which hereafter may be in
force.
3. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Health Department
Palm Desert Water and Services District
City Fire Marshal
Coachella Valley Water District
4. Location and design of trash enclosures shall be coordinated with Palm
Desert Disposal Company.
5. Applicant shall join the President's Plaza parking maintenance district.
6. Applicant shall restripe President's Plaza parking isle to be consistent
with traffic flow from proposed driveway.
7. Project architecture shall reflect a more traditional
span i sh/med i terranean style.
Department of Public Works:
1. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to grading permit issuance.
2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
3. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
4. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall

submit "as -built" plans prior to the acceptance of the improvements by
the city.
5. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
6. Landscaping maintenance on Portola Avenue and Palm Desert Drive South
shall be provided by the property owner.
7. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
issuance of any permits.
8. Installation of sidewalk on Palm Desert Drive South and Portola Avenue.
9. Close unused driveway with full height curb and gutter.
10. Off -site improvement plans to be approved by public works department and a
surety posted to guarantee the required off -site improvements prior to
grading permit issuance.
11. Traffic analysis to be prepared for the project to address the specific
impacts on existing networks (street and intersections) and then proposed
mitigation measures recommended for approval by the city.
12. Size, number and location of driveways to public works specifications
with only two driveway approaches to be allowed to serve this property.
13. Driveway approaches shall be no wider than thirty (30) feet as per city
standards no. 105.
14. Dedicate 22 feet of right-of-way on the west side of property for south
bound one way travel. City shall vacate 20 feet of the right-of-way on
the north boundary as part of this project.
15. Highway 111 parkway break subject to Caltrans approval.
City fire Marshal:
1. All plans for underground tank abandonment and new tank installation
shall be sent to Riverside County Environmental Health Department, 3615
l2th Street, Riverside, California, 92501, Attention: Chuck Strey.
2. One set of approved plans from County Environmental Health shall be sent
to local fire marshal for review.
