A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO
CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT, CHANGE OF ZONE AND
PRECISE PLAN TO ALLOW CONSTRUCTION OF A 11,225
SQUARE FOOT OFFICE BUILDING LOCATED AT THE
SOUTHEAST CORNER OF FRED WARING DRIVE AND
FAIRHAVEN DRIVE.
CASE NO: CZ 86-9 AND PP 86-48
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 18th day of November, 1986 hold a duly noticed public hearing to
consider a request by MR. GERALD CHAZAN for approval of a negative declaration
of environmental impact, change of zone from R-1 to OP and a precise plan to
allow construction of a 11,225 square foot office building located at the
southeast corner of Fred Waring Drive and Fairhaven Drive.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures for Implementation of the California Environmental
Quality Act, Resolution No. 80-89", in that the director of community
development has determined that the project will not have a significant impact
on the environment and a negative declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard. said planning commission did find the following facts to exist to
justify their actions:
FINDINGS FOR APPROVAL OF CHANGE OF ZONE:
1. The proposed Office Professional zone is consistent with the Palm
Desert General Plan and the Palma Village Specific Plan.
2. The Office Professional zone is more appropriate at this location
and better protects the public health, safety and welfare than the
existing R-1 designation.
FINDINGS FOR APPROVAL OF THE PRECISE PLAN:
1. The project meets all design standards of the OP zone and other
applicable City of Palm Desert Zoning Ordinances.
2. The proposed project will be of high quality, will be compatible
with adjacent uses and will not depreciate property values in the
vicinity.
3. The proposed project will not endanger the public health, safety or
general welfare.
4. The proposal will not interfere with the lawful use or enjoyment of
property in the vicinity.

NOW. THEREFORE. BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California. as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. A negative declaration of environmental impact is recommended for
approval.
3. CZ 86-9 Exhibit "A" and PP 86-48 on file in the department of
community development is hereby recommended to city council for
approval subject to attached conditions.
PASSED. APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 18th day of November, 1986 by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP 86-48
Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development as modified by the
following conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein in addition to all municipal
ordinances and state and federal statutes now in force or which hereafter
may be in force.
3. Construction of a portion of said project shall commence within one year
from the date of final approval unless a time extension is granted, other-
wise said approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contem-
plated by this approval, the applicant shall first obtain permits and/or
clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Water and Services District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. All roof mounted mechanical equipment shall be screened from all sides
with materials similar to building walls.
6. Trash provisions shall be approved by applicable trash company and city
prior to issuance of building permit.
7. Project shall be subject to Art in Public Places fee per Ordinance No.
473.
Department of Public Works:
I. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to grading permit issuance.

2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
3. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
4. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the director of public works for checking and
approval before construction of any improvements is commenced. The
engineer shall submit "as -built" plans prior to the acceptance of the
improvements by the city.
5. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid
prior to grading permit issuance.
6. Landscaping maintenance on Fred Waring Drive and Fairhaven Drive shall be
provided by the property owner.
7. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the director of public works for checking and approval
prior to issuance of any permits.
8. Installation of curb, gutter and matching paving and eight foot sidewalk
on Fairhaven Drive.
9. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
grading permit issuance.
10. Size. number and location of driveways to public works specifications
with only two driveway approaches to be allowed to serve this property.
11. Grading permit issuance shall be subject to the waiver of parcel map
first being approved and recorded.
12. Any and all off -site improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permit by the department of
public works.
13. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to issuance of the grading permit.

City Fire Marshal:
1. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a 3 hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the fire marshal
for review. Upon approval, one copy will be sent to the building
department and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company with the following certification: "I
certify that the design of the water system in PP 86-48 is in accordance
with the requirements prescribed by the fire marshal".
5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
7. All buildings over 5000 square feet require an approved fire sprinkler
system.
