HomeMy WebLinkAboutRes No 1194PLANNING COMMISSION RESOLUTION N0. 1194 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF A 168 UNIT INN AND A FULL SERVICE RESTAURANT AND GAS STATION WITHIN A 10 ACRES IN THE PC (4) S.P. AND PR-5 N, S.P. ZONE AT THE NORTHEAST CORNER OF HIGHWAY 111 AND DEEP CANYON ROAD. CASE NO. PP 86-45 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 4th day of November, 1986. hold a duly noticed public hearing to consider the request of THOMAS MiLLER for the above described project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the Caiiforni,3 Environmental Quality Act, Resolution No. 80--89," in that the director of community development has determined that the project will not have a significant environmental impact and a negative declaration is hereby certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments. if any, of all interested persons desiring to be heard, said planning commission did Find the following facts and reasons to exist to justify granting approval of said precise plan: 1 The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as fo1 ows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; That approval of Precise Plan 86-45 is hereby granted for reasons subject to the attached conditions. DIAZ, Secreta / 2 RICHARD ERWOOD, Chairman PLANNING COMMISSION RESOLUTION NO. 1194 CONDITIONS OF APPROVAL CASE NO. PP 86-45 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. L. Construction of a portion of said project shall :commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may he in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Public Works Department Palm Desert Water 8 Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. the hotel shall provide solid -core or steel doors equipped with dead bolt locks, door viewers and latch guards. 6. The addressing of the rooms should use even numbers to the left and odd numbers to the right to assist emergency vehicles in locating rooms. 7. Access to Highway 111 must be approved by Caltrans and City of Palm Desert Public Works department. H. The requested assurances from the developer by the Hidden Palms Homeowners Association will become conditions of approval, and have been expressed as follows: 3 PLANNING COMMISSION RESOLUTION NO. 1194 a. That there be no usable balconies on the north side of their property facing toward Hidden Palms. O. A 90 foot setback from the building line to the Hidden Palms wall will be provided on the northern property line. r_. That a minimum of two rows of existing date palms remain as a barrier between the Hidden Palms wall and the proposed parking area. d. That additional planting be done under the date palm barrier to a height capable of softening the effect of only seeing the palm tree trunks from Hidden Palms. e. That they prefer tile to be used at the gas station building, rather than metal. f. That no obtrusive lighting be done on the north side to illuminate the hot water building, parking area or- planned amenities. g• That the trash enclosure be moved from the northwest corner for noise and odor consideration. 9. Handicap parking stalls shall be distributed appropriately throughout entire site. 10. Detailed parking iot and building lighting plan shall be submitted to staff for approval, subject to applicable lighting standards, plan to he prepared by a qualified lighting engineer. 11. Three to 3.5 foot mounding shall be provided to sufficiently screen parking lot areas from streets. l2. lrash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 13. All roof -mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 14. Project shall be subject to art in public places fee per Ordinance No. 473. 15. A parcel map filing shall create parcels to the satisfaction of the director of community development. 16. The architecture of the future restaurant shall be compatible with the hotel. 4 PLANNING COMMISSION RESOLUTION NO. 1194 17. All on -site utilities, including cable television, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of community development. 18. Only delivery diesel trucks built after 1974 shall be used. 19. All conditions of the architectural commission shall he met. 20. The precise plan will contain and provide all items delineated in the staff report dated December 16, 1986. 21. Decorative walls shall be compatible with adjacent developments. 22. Car wash may be operated only between the hours of 8:00 a.m. and 6:00 p.m. 23. The car wash shall also be built so that the door on the north end of the building shall be closed while the car wash is in operation. 24. The service station shall be redesigned to he more compatible with the Residence Inn to reflect the concerns identified by the staff report dated December 16, 1986. 25. The date paims on the site shall be maintained. In the event that a date palm dies or requires removal, it shall be replaced by a tree approved by city staff. Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. S. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to the acceptance of the improvements by the city. PLANNING COMMISSION RESOLUTION NO. 1194 6. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 7. Landscaping maintenance on Highway 111 and Deep Canyon Road shall be provided by the property owner. 8. Existing utilities on Highway 111 and Deep Canyon Road shall be undergrounded per each respective utility district's recommendation. If determined to be unfeasible applicant shall agree to participate in any future utility undergrounding district. 9. Traffic safety striping on Highway 111 and Deep Canyon Road shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 10. Complete grading plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 11. Dedication of 55/58 feet of right-of-way on Highway 111 and Deep Canyon shall be done prior to issuance of any permits and approval of plans. 12. Installation of curb and gutter, matching paving and 8 foot meandering sidewalk on Highway 111 and Deep Canyon Road. 13. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 14. Installation of one-half landscaped median in Highway 111 or cash payment for one-half the cost of landscaped median at the option of the director of public works. 15. Traffic analysis to the prepared for the project to address the specific impacts on existing networks (street and intersections) and the proposed mitigation measures recommended for approval by the city. 16. ize, number and location of driveways to public works specifications with only three driveway approaches to be allowed to serve this property. 17. Complete parcel map shall be submitted as required by ordinance to the director of public works for checking and approval and be recorded before issuance of any permits. 18. A complete preliminary soils investigation, conducted by a registered soils engineer, shall he submitted to and approved by the department of public_ works prior to issuance of the grading permit. 20. Access to Highway 111 shall be restricted through raised median;, to right turn ingress and egress and approved by Caltrans. 21. A secondary access, 24 feet wide, shall he provided on Deep Canyon Road at the project's north boundary. 22. Applicant shall provide for bus turnout on Highway 111 to the satisfaction of the director of public_ works and Sunline Transit Agency. 23. All improvements within the State right-of-way shall be constructed to Caltrans standards. 24. Median islands at both project entrances as shown on the project site plan shall be continuous and extend into driveways far enough to preclude/minimize potential vehicle conflict. 25. If traffic conflicts develop, as determined by the director of public works, at the most southerly driveway on Deep Canyon Road applicant shall modify drive to restrict movements to right turn ingress/egress only. 26. Access driveways shall be a minimum of 24 feet For Highway 111 entry and Deep Canyon exit, and 18 feet for Highway 111 exit and Deep Canyon entry. 27. Existing signal at Deep Canyon and Highway 111 shall be modified to the satisfaction of both Caltrans and the City of Palm Desert. City Fire Marshal: 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. 1 PLANNING COMMISSION RESOLUTION NO. 1194 b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer ano approved by the water company, with the following certification: "1 certify that. the design of the water system in Case No. PP 86-45 is in accordance with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may he necessary when the applicant submits specific plans for consideration and approval. 7. All building over 5000 square feet require an approved fire sprinkler system. 8. All three story buildings must have a fire marshal approved fire alarm system. 8
