A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO ALLOW EXPANSION OF
EXISTING CHURCH FACILITIES INCLUDING CONSTRUCTION
OF A 27,692 SQUARE FOOT SANCTUARY ON 6.72 ACRES
BOUNDED BY HIGHWAY 74, THE PALM VALLEY STORM
CHANNEL AND THE PALM DESERT COMMUNITY CHURCH
PROPERTY.
CASE NO. CUP 87-5
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 21st day of April, 1987, hold a duly noticed public hearing to
consider the request of ST. MARGARETS EPISCOPAL CHURCH for the above mentioned
project; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will not have a significant impact
on the environment and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify the granting of said conditional use permit:
1 The proposed location of the conditional use is in accord with the
objectives of the zoning ordinance and the purpose of the district
in which the site is located.
2. The proposed location of the conditional use and the conditions
under which it will he operated and maintained will not he
detrimental to the public health, safety or general welfare, or be
materially injurious to properties or improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or
adjustments.
4. The proposed conditional use complies with the goals, objectives,
and policies of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That approval of Conditional Use Permit 87-5 is hereby granted for
reasons subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 2lst day of April, 1987, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 87-5
Department of Community Development/Planning:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Palm Desert Water & Services District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Trash provisions shall be approved by applicable trash company and city
prior to issuance of building permit.
6. Project shall be subject to Art in Public Places fee per Ordinance No.
473.
7. All access driveways shall be designed for high speed ingress.
8. All drives and curb entrance throats shall be designed to have a minimum
length of 50 feet and parking area shall be redesigned to meet this
requirement.

Department of Public Works:
1. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to grading permit issuance.
2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
3. Full public improvements, including traffic safety lighting as required
by ordinance and the director of public works, shall be installed in
accordance with California Department of Transportation standards.
4. Improvement plans for water and sewer systems shall be approved by the
respective service districts with "as -built" plans submitted to the
department of public works prior to the project final.
5. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the department of transportation for checking
and approve before construction of any improvements is commenced. The
engineer shall submit "as -built" plans prior to the acceptance of the
improvements by the city.
6. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
7. Landscaping maintenance on State Route 74 shall be provided by the
property owner.
8. Existing utilities on State Route 74 shall be undergrounded per each
respective utility district's recommendation. If determined to be
unfeasible applicant shall agree to participate in any future utility
undergrounding district.
9. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the director of public works for checking and approval
prior to issuance of any permits.
10. installation of concrete curb and gutter, matching paving and eight -foot
meandering sidewalk on State Route 74.
11. Close unused driveway with full height concrete curb and gutter.
12. Clffsite improvement plans to be approved by the department of
transportation and the department of public works and a surety posted to
guarantee the required offsite improvements prior to grading permit
issuance.

13. Installation of sewers to serve this project.
14. Size, number and location of driveways to public works specifications
with only three driveway approaches to be allowed to serve this property.
15. Any and all off -site improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permit(s) by the department
of transportation.
16. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall he submitted to and approved by the department of
public works prior to issuance of the grading permit.
17. Existing and proposed access to State Route 74 shall be one-way ingress
or egress only. "Entrance" and "Exit" signs shall be placed to delineate
traffic flow direction.
18. Proposed landscaping scheme along entire highway frontage shall not
interfere with sight distances for on -coming traffic.
19. All improvements within the Highway 74 right-of-way shall be in accordance
with Caltrans standards.
City Fire Marshal:
1. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a three hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall he painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the
original and two copies of the water system plan to the fire marshal for
review. Upon approval, one copy will be sent to the building department,
and the original will be returned to the developer.

4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "1
certify that the design of the water system in Case No. CUP 87-5 is in
accordance with the requirements prescribed by the fire marshal."
5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating, and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
7. All buildings 5000 square feet require an approved fire sprinkler system.
8. Install a class 1V type A state fire marshal approved fire alarm system.
