HomeMy WebLinkAboutRes No 1218PLANNING COMMISSION RESOLUTION NO. 1218 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO CONSOLIDATE EIGHT PARCELS INTO THREE ALONG THE EAST SIDE OF THE PALM VALLEY STORMWATER CHANNEL SOUTH OF HEDGEHOG STREET, WEST OF THE KINGS POINT DEVELOPMENT CASE NO. PM 22499 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of April, 1987, hold a duly noticed public hearing to consider the request of WILLIAM MURRAY & ASSOCIATES, INC. for approval of the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project has been previously assessed and a negative declaration has been approved; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify recommending approval of the parcel map: 1. The proposed map, its design, improvements, type of development and density are consistent with the State Subdivision Map Act, the Palm Desert Subdivision, Zoning Ordinance, and General Plan. 2. The design of the subdivision insures that the project will not result in environmental damage, injure fish or wildlife, degrade water quality or create public health problems. 3. The map will not conflict with public easements. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That Tentative Parcel Map No. 22499, is hereby approved. DIAZ, Secreta /tm 2 RICHARD ERWOOD, Chairman PLANNING COMMISSION RESOLUTION NO. 1218 CONDITIONS OF APPROVAL CASE NO. PM 22499 Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall he paid prior to grading permit. issuance. 2. Drainage facilities shall be provided, per ordinance no. 218 and the master drainage plan, to the specifications of the director of public works. 3. Storm drain construction shall he contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Full public improvements, including traffic_ safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards at the time of grading/construction permits issuance. 5. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as=built" plans prior to the acceptance of the improvements by the city. 6. All private streets shall be inspected by the engineering department and a standard inspection fee shall he paid prior to grading permit issuance. 7. Landscaping maintenance on Edgehill/Green Way shall he provided by the property owner at the time of grading/construction permit issuance. 8. Complete grading plans and specifications shall he submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 9. Dedication sufficient right-of-way on Edgehill/Green Way for a 60 foot radius curve shall be done prior to issuance of any permits and approval of plans. 10. Installation of curb and gutter, matching paving and sidewalk on Edgehill/Green Way at the time of grading/construction permit issuance. 11. Waiver of access to Edgehill except at approved locations shall be granted on the final map. 3 PLANNING COMMISSION RESOLUTION NO. 1218 12. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 13. Full improvement of interior streets based on private street standards as established in accordance with Chapter 26, Section 26.40.040, C.P.D. Code. 14. Traffic analysis to be prepared for the project to address the specific impacts on existing networks (street and intersections) and the proposed mitigation measures recommended for approval by the city. 15. Complete parcel map(s) shall be submitted as required by ordinance to the director of public works for checking and approval and be recorded before issuance of any permits. 16. Any and all off=site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit.(s) by the department of public works. 17. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 4
