HomeMy WebLinkAboutRes No 1221PLANNING COMMISSION RESOLUTION N0. 1221 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT, CHANGE OF ZONE FROM R-2 S.P. TO O.P. AND A PRECISE PLAN FOR AN OFFICE BUILDING TO BE LOCATED ON THE NORTH SIDE OF FRED WARING DRIVE BETWEEN ADONIS DRIVE AND ACACIA DRIVE. CASE N0: CZ 87-3 8 PP 87-14 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the l9th day of May 1987 hold a duly noticed public hearing to consider a request by RAY -AL ENTERPRISES INC. for approval of a negative declaration of environmental impact, change of zone from R-2 S.P. to O.P. and a precise plan for an office building to be located on the north side of Fred Waring Drive between Adonis Drive and Acacia Drive. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: CHANGE OF ZONE: 1. The proposed office professional zone is more appropriate than the existing residential designation considering noise and other impacts associated with the high level of traffic on Fred Waring Drive. 2. The proposed O.P. zone is consistent with the Palma Village Specific_ Plan and will promote the health, safety and general welfare in the area. PRECISE PLAN: 1. The proposed professional office development complies with the standards of the O.P. zone and other applicable city ordinances and is consistent with intent of the Palma Village Specific Plan. 2. The site plan and architecture are compatible with adjacent land uses. PLANNING COMMISSION RESOLUTION NO. 1221 3. The project will therefore not depreciate adjacent property values, restrict the lawful use thereof nor will it present a threat to the public health safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That a negative declaration of environmental impact Exhibit "A", change of zone 87-3 Exhibit "B", and precise plan 87-14 on file in the Department of Community Development/Planning be recommended for approval to City Council subject to attached conditions. DIAZ, Secre /hs 2 IM RICHARDS, Vice C airman INS PLANNING COMMISSION RESOLUTION NO. 1221 CONDITIONS OF APPROVAL CASE NO. PP 87-14 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Property Owner's Association 6. That prior to issuance of building permit the owner (developer) provide the city with evidence that he has paid the required school mitigation fee. 7. The trash enclosures shall be located as approved by Palm Desert Disposal. 8. That the landscaping perimeter strip between the open parking spaces and the perimeter wall be provided as required by ordinance to the satisfaction of the city's architectural commission. 9. That the applicant enter into an agreement with the city guaranteeing that the property will voluntarily be a part of any undergrounding 3 PLANNING COMMISSION RESOLUTION NO. 1221 district which may be established by the city, including the property in question. The form of this agreement shall be acceptable to the city attorney and shall run with the land. This condition shall not be applicable to the service lines that lead directly to the building(s) which must be undergrounded. 10. Applicant shall install signage at each exit directing traffic toward Fred Waring to the satisfaction of the departments of community development and public works. Department of Public Works: 1. Drainage and signalization fund fees, as required by City ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the Department of Public Works. 3. Full public improvements, including traffic safety lighting, as required by ordinance and the Director of Public Works, shall be installed in accordance with City standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the Director of Public Works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to the acceptance of the improvements by the City. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Acacia Dr., Adonis Dr., and Fred Waring Drive shall be provided by the property owners. 7. Existing utilities on Fred Waring Drive and within subject site shall be underground per each respective utility district's recommendation. If determined to be unfeasible applicant shall agree to participate in any future utility undergrounding district. easement. 8. Complete grading plans and specifications shall be submitted, as required by ordinance, to the Director of Public Works for checking and approval prior to issuance of any permits. 9. Installation of curb and gutter and matching paving on Acacia Drive and Adonis Drive, and eight foot wide sidewalk on Fred Waring Drive. 4 PLANNING COMMISSION RESOLUTION NO. 1221 10. Offsite improvement plans to be approved by Public Works Department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 1l. Size, number and location of drive4ways to Public Works specifications with only two driveway approaches to be allowed to serve this property. 12. Complete parcel map shall be submitted as required by ordinance to the Director of Public Works for checking and approval and be recorded before issuance of any permits. 13. Any and all off -site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works. 14. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the Department of Public Works prior to issuance of the grading permit. 15. Applicant shall secure reciprocal ingress and egress access easements from the owners of lots 25, 26, 27, 28 and 29. frontage. 16. Direction of angled parking spaces should be reversed to allow for smoother traffic flow in parking lot. 17. Installation of handicap ramps at both curb returns, with sidewalk wrapping around entire radius of curb returns. City Fire Marshal: 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. 5 PLANNING COMMISSION RESOLUTION NO. 1221 b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 87-14 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. All buildings over 5000 square feet require an approved fire sprinkler system. 8. Driveway entrance to have 50' turning radius. /hs 6
