A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, FOR APPROVAL OF
A 20,784 SQUARE FOOT TWO-STORY OFFICE COMPLEX
LOCATED IN AN OFFICE PROFESSIONAL ZONE AT THE
SOUTHWEST CORNER OF MONTEREY AVENUE AND FRED
WARING DRIVE.
CASE N0: PP 87-24
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 7th day of July, 1987 hold a duly noticed public hearing to consider
the request of MONTEREY INVESTMENT GROUP for above mentioned project; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of community development has
determined that the project will not have an adverse impact on the environment
and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all testi-
mony and arguments, of all interested persons desiring to be heard, said
commission did find the following facts and reasons to exist to justify the
granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. The precise plan will not endanger the public peace, health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case.
2. That approval of Precise Plan PP 87-24 is hereby granted for reasons
subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of July, 1987, by the following vote,
to wit:

CONDITIONS Of APPROVAL
CASE NO. PP 87-24
Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all municipal code requirements
to the degree that the city could consider each phase as a single project.
3. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, void and of no effect
whatsoever.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
5. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Property Owner's Association
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
6. Detailed lighting plan in compliance with applicable lighting level
standards shall be submitted to the city for approval; lights to be
downshining box type with recessed light source and shields facing
residential area.
7. In lieu of undergrounding existing utility distribution lines on property
as a part of construction, the applicant shall record an agreement
guaranteeing that the property will voluntarily be a part of any

undergrounding district which is subsequently established by the city
including the property in question.
8. Approval shall be subject to elimination of open views from second story
from windows, balconies or walkways.
9. Prior to issuance of building permit, applicant shall record easement for
access and circulation purposes; easement to permit common 24 foot wide
drive with property to south and permit traffic from north and south to
drive on site for access to Monterey Avenue and the vacated Sonora Drive.
10. Six foot high block wall shall be provided along rear property line; wall
to be constructed prior to start of construction of building.
II. Applicant to pay applicable fees for "Art in Public Places" or satisfy
the requirements and school impact prior to building permit issuance.
Department of Public Works:
1. Drainage and signalization fund fees, as required by City ordinance,
shall be paid prior to recordation of the final map.
2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the Department of Public Works.
3. Full public improvements, including traffic safety lighting, as required
by ordinance and the Director of Public Works, shall be installed in
accordance with City standards.
4. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the Director of Public Works for checking and
approval before construction of any improvements is commenced. The
engineer shall submit "as -built" plans prior to the acceptance of the
improvements by the City.
5. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
6. Landscaping maintenance on Monterey Avenue and Fred Waring Drive shall be
provided by the property owner.
7. Existing utilities shall be undergrounded per each respective utility
district's recommendation. If determined to be unfeasible applicant
shall agree to participate in any future utility undergrounding district.

8. Complete grading plans and specifications shall be submitted. as required
by ordinance, to the Director of Public Works for checking and approval
prior to issuance of any permits.
9. Waiver of access to Monterey Avenue/Fred Waring Drive except at approved
locations shall be granted on the final map.
10. Offsite improvement plans to be approved by Public Works Department and a
surety posted to guarantee the required offsite improvements prior to
recordation of the final map.
11. Size, number and location of driveways to Public Works specifications
with only one driveway approach to be allowed to serve this property.
12. Complete parcel map shall be submitted as required by ordinance to the
Director of Public Works for checking and approval and be recorded before
issuance of any permits.
13. Any and all off -site improvements shall be preceded by the approval of
plans and issuance of valid encroachment permits by the Department of
Public Works.
14. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the Department of
Public Works prior to issuance of the grading permit.
15. Applicant shall secure reciprocal ingress and egress access easements
from the owners of lots 7, 8 and 9.
16. Applicant shall grant to the owners of lots 7, 8 and 9 an easement for
drainage purposes along the southern boundary of lot 6.
